[ ADMINISTRATIVE ORDER NO. 23, September 15, 1936 ]

SUSPENDING JUSTICE OF THE PEACE TEODORO A. AVILES OF ORMOC, LEYTE, FROM OFFICE



After a thorough and careful review of the report of investigation of the administrative case against Justice of the Peace Teodoro A. Aviles of Ormoc, Leyte, I find that the respondent had delayed for a considerable length of time, without justifiable cause, the rendering of his decision in Civil Cases Nos. 1047 and 1076. While I desire that the cases presented for decision should be carefully studied and considered, I find the delay of over one year in the disposition of this case highly inexcusable and prove the respondent Justice of the Peace guilty of gross negligence.

This irregularity committed by the respondent is sufficient to justify severe administrative action. Considering, however, that there appears no evidence to show that the irregularity in question had been committed in bad faith, and upon the recommendation of the Secretary of Justice, Teodoro A. Aviles is hereby ordered suspended only from the office of Justice of the Peace of Ormoc, Leyte, for a period of two months, with an admonition that a repetition of similar negligence in the future will be dealt with more severely.
