[ ADMINISTRATIVE ORDER NO. 47, September 21, 1937 ]

DISMISSING JUSTICE OF THE PEACE EDILBERTO RINA OF POLILLO, TAYABAS, FROM OFFICE



The Department of Justice has reported to this Office that the respondent dismissed the complaint in criminal case Numbered Four hundred seventy-six and acquitted the accused, in criminal case Numbered Four hundred seventy-seven, without justifiable cause. It was also reported that the respondent is suffering from “alcoholic paranoid.”

Upon the recommendation of the Undersecretary of Justice, this Office on July sixteenth, nineteen hundred and thirty-seven, requested the respondent to tender his resignation from the office of Justice of the Peace of Polillo, Tayabas, within a period of thirty days from the receipt of the said letter, and warned him that if he fails to do so, this Office will order his removal.

In view of the failure of the respondent to tender his resignation, either to the Judge of the Court of First Instance of Tayabas or to the Secretary of Justice, as required, and considering that his further continuance in office will have a demoralizing effect in his community, the respondent should not be allowed to stay in the judiciary. Edilberto Rina is hereby, therefore, ordered dismissed from the office of Justice of the Peace of Polillo, Tayabas, for the good of the service.

Done at the City of Manila, this twenty-first day of September, in the year of Our Lord, nineteen hundred and thirty-seven, and the Commonwealth of the Philippines, the second.
