1997 PORT CHANGES AND PRIVILEGE FEES ON MOTOR VEHICLES ENTERING THE CEBU DOMESTIC PORT



To ensure maximum utilization of the port facilities and the smooth movement of vehicles inside the Cebu Domestic Port and at the same time enable this Authority to collect port charges due from use of port facilities as mandated in R.A. 7621 otherwise known as the Charter of the Cebu Port Authority, the following port charges and privilege fees on all types of motor vehicles entering the Cebu Domestic Port are hereby promulgated for the information, guidance of and compliance by all concerned:

Statement of Policy

It is the declared policy of the Authority that no motor vehicle shall be allowed to enter the port premises unless on legitimate business or purpose and with permit /pass issued by the authority.

III

Period of Application, Condition

Application form can be secured from CPA Administrative Building and should be filed starting January but not later than 31 March 1997 for the 1997 Annual Vehicle Pass (AVP) and starting October but not later than 30 November this year and every year thereafter for oncoming year’s AVP.

Temporary Motor Vehicle Pass may be applied for and obtained from authorized personnel at the entrance gate.

No pass shall be issued to an applicant who has a pending complaint or case filed with the Authority or to one with an unsettled account/obligation with the CPA.

IV

Cancellation/Revocation of Pass

Any pass issued by the Authority may be canceled or revoked for violation of any of the rules and regulations of the CPA.

V

Limitation and Duration of Pass

Entry into the premises of the Cebu Domestic Port is a privilege not a right.  The Authority therefore reserves the right to deny entry to a pass holder/grantee when the situation demands or when deemed to be for the public benefit and interest.

Pass issued pursuant to this circular shall be valid only for the year the same was issued.  Likewise, a domestic pass shall not be valid for entry into the Cebu International Port for which a separate pass is required.

VI

Violation of Port Rules and Regulations

Without prejudice to other legal remedies/actions which the Authority may take, any violation of this circular and/or traffic and safety regulations issued by the Authority shall, after due notice and hearing, be penalized as follows:

1.         1st Offense — Five Hundred Pesos (P500.00) fine with warning;

2.         2nd Offense — One Thousand Pesos (P1,000) fine with suspension of privilege;

3.         3rd Offense — Cancellation of the Privilege

The driver, owner of the vehicle/chassis/trailer or other vehicle and/or the pass holder/grantee shall be solidarily liable for the payment of the above fines.

VII

Repealing Clause

This Memorandum Circular amends or modifies all other issuances inconsistent herewith.

VIII

Effectivity

This Circular shall take effect fifteen (15) days after publication in any newspaper of general circulation.
