REGULATION THE VOLUME OF PUBLIC MOTOR VEHICLES ON ALL ROADS IN METRO MANILA THROUGH THE VEHICULAR VOLUME REDUCTION PROGRAM



WHEREAS, RA 7924 mandates the Metropolitan Manila Development Authority (MMDA) to set policies on traffic in Metro Manila, coordinate and regulate the implementation of all programs and projects concerning traffic management including the institution of a system to regulate road users among others:

WHEREAS, the Metro Manila (Council) of the MMDA, in the exercise of its rule making power, had promulgated MMDA Regulation No. 95-001 entitled "Regulating the Volume of Private Vehicles in Identified Critical Thoroughfares in Metro Manila Through the Vehicular Volume Reduction Program";

WHEREAS, said MMDA Regulation No. 95-001 still is and continues to be in full force and effect, and had resulted in faster travel time along the twelve (12) major thoroughfares identified therein;

WHEREAS, it has been further observed that during non-peak hours (9:00 a.m. to 5:00 p.m.) PUBs and PUJs usually crowd in identified but officially unauthorized terminals, while taxis queue at the hotels, malls, ports and airports and still other buses and PUJs queue at length at loading/unloading stations along the aforementioned 12 major thoroughfares and all these have added to traffic congestion while at the same time further contributing to air pollution thru their engine emissions;

WHEREAS, Regulation No. 95-001 applies solely to private vehicles to the exclusion of the public utility vehicles, the jeepneys, taxis and buses;

WHEREAS, in view of the foregoing there is a need to rationalize the efficiency of these public utility vehicles by a similar regulation solely and separately for public utility vehicles, PUJs, Taxis, and PUBs.

NOW, THEREFORE, pursuant to Sec. 6 of Republic Act 7924, be it resolved as it is hereby resolved by the Council in session assembled as it is hereby affirms the continued enforcement of Regulation No. 95-001 [generally referred to as the ODD-EVEN Scheme];

RESOLVED FURTHER, that a separate scheme be adopted as it is hereby adopted for utility vehicles which include PUJs, PUBs and Taxis (yellow plate) as follows:

SECTION 1. Public Vehicles with license plates ending as shown in the succeeding paragraph hereof shall be off from all roads of Metro Manila during the corresponding days herein indicated, from 9:00 a.m. to 5:00 p.m.

SECTION 2. The following public utility vehicles shall be exempted from this Regulation:

a. Public vehicles commandeered by the government, directed by a person in authority or his agent and/or by a medical practitioner for military relief and emergency purposes;

b. Public vehicles carrying persons that need to be treated immediately without delay at the nearest hospital or medical institution.

In both of the above cases, the driver will have to secure certification from the appropriate entity or person that said vehicles was in truth used for one or any of the above purposes.

SECTION 3. Violation of this regulation shall be penalized with a fine of Three Hundred (P300.00) Pesos per offense.

SECTION 4. Any Ordinance, Rules and Regulations and other Issuances found to be inconsistent with this regulation is/are hereby repealed or modified accordingly.

SECTION 5. This Regulation shall take effect February 19, 1996.
