REGISTRATION OF CONFISCATED AND FORFEITED MOTOR VEHICLES USED IN THE TRANSPORT OF ILLEGALLY SOURCED FOREST PRODUCTS



Pursuant to the Memorandum of Agreement (MOA) entered into by and between the Department of Environment and Natural Resources (DENR) and the Department of Transportation and Communications (DOTC) on 15 February 1996, re: registration of confiscated and forfeited motor vehicles used in the transport of illegally sourced forest products and in violation of PD 705 as amended, the following guidelines are hereby issued:

1.         LTO shall accept registration of confiscated/forfeited motor vehicles as stipulated in the MOA upon compliance by the DENR with the following documents:
a.      Court decision in the seizure proceedings;
b.      CHPFG clearance;
c.      Appropriate Insurance Certificate of Cover;
d.      LTFRB order of dropping of unit (if for -hire);
e.      Notice/approval from the financing company if Certificate of Registration is encumbered;
f.       Surrender of plates;
g.      Actual motor vehicle inspection and duly accomplished Motor Vehicle Inspection Report.
2.         DENR shall pay the registration fees and other authorized charges to LTO as required by existing laws, rules and regulations.

3.         LTO shall facilitate the issuance of Certificate of Registration of the confiscated motor vehicles in the name of the government to be recorded in the books of DENR in accordance with the existing rules and regulations.
