[ MMDA RESOLUTION NO. 97-02, February 13, 1997 ]

REQUESTING THE DEPARTMENT OF INTERIOR AND LOCAL GOVERNMENT AND THE PHILIPPINE NATIONAL POLICE TO PROVIDE THE MAYORS OF METROPOLITAN MANILA SPECIFIC GUIDELINES ON THE MANNER OF REPLACEMENT OF A CHIEF OF POLICE OF CITY AND MUNICIPAL POLICE STATIONS AND OTHER POLICE PERSONNEL IN METRO MANILA



WHEREAS, it is a declared policy of the State to promote peace and order, ensure public safety and further strengthen local government capability aimed towards the effective delivery of the basic services to the citizenry through the establishment of a highly efficient and competent police force that is national in scope and civilian in character;

WHEREAS, Section 51 of Republic Act 6975, otherwise known as the "Department of Interior and Local Government Act of 1990," empowers the local government executives to exercise operational supervision and control over PNP units in their respective jurisdiction except during the thirty (30) day period immediately preceding and the thirty (30) days following any national, local or barangay elections;

WHEREAS, in addition to the aforementioned powers, x x x city and municipal mayors shall have the following authority over the PNP units in their respective jurisdictions:

(i)      Authority to choose the chief of police from a list of five (5) eligibles recommended by the provincial police director, preferably from the same province, city or municipality;

(ii)     Authority to recommend the transfer, reassignment or detail of PNP members outside of their respective city or town residences; and;

(iii)    Authority to recommend, from the list of eligibles previously screened by the peace and order council, the appointment of new members of the PNP to be assigned to their respective cities or municipalities without which no such appointment shall be attested.

WHEREAS, in the aforementioned powers of the local government officials over the PNP Units or Forces, there is no mention of any set of rules or specific guidelines of the DILG-PNP on the manner of replacement of chief of police and/or municipal station commanders;

WHEREAS, the Metro Manila Council, in its meeting of February 13, 1997, aired their concern over the unstable flight of a chief of police or a municipal station commander, especially when their respective district commanders are being replaced and/or reassigned to another area by the Chief of the Philippine National Police, which in the process impedes the existing coordinative efforts of the local governments relative to the maintenance of peace and order, administration of justice and enforcement of all laws and ordinances;

NOW THEREFORE, be it resolved, as it is hereby resolved by the Council, pursuant to Section 6 of R A 7924, that the Council adopts a Resolution requesting the Secretary of the Department of Interior and Local Government and the Chief of Philippine National Police to provide the Mayors of Metropolitan Manila specific guidelines on the manner of replacement of chief of police of city and municipal stations and other police personnel in Metro Manila.

This Resolution shall take effect upon approval.
