CREATION OF THE ANTI-SMUGGLING UNIT FOR MOTOR VEHICLES (AS-U-MOVE) PURSUANT TO EXECUTIVE ORDER NO. 363, DEFINING ITS POWERS AND FUNCTIONS



I. OBJECTIVES:

1.1. To prepare and implement effective measures to prevent and suppress smuggling of motor vehicles.

1.2. To combat smuggling of motor vehicles outside the Customs area pursuant to E.O. No. 363.

1.3. To pursue smuggled motor vehicles in places considered as hot zones, including but not limited to, Clark, Subic, Batangas, Cebu, Davao.

II. SCOPE AND COVERAGE:

2.1. This Order shall cover all smuggled motor vehicles.

III. ADMINISTRATIVE PROVISIONS:

3.1. There is hereby created an Anti-Smuggling Unit for Motor Vehicles (AS-U-MOVE) which shall be attached to the Office of the Commissioner.

3.2. The AS-U-MOVE shall have the following powers and functions, to wit:

3.2.1. Prepare and implement an effective campaign against smuggling of motor vehicles;

3.2.2. Coordinate with VICMU-IEG and the Land Transportation Office in identifying imported motor vehicles released from Customs territory which have not passed or complied with the requirement of the TCCP and other laws.

3.2.3. Enlist the assistance of other law enforcement agencies, i.e, Land Transportation Office (LTO), Traffic Management Group - Philippine National Police (TMG-PNP), Metro Manila Development Authority (MMDA), etc. in going after smuggled motor vehicles;

3.2.4. Recommend the issuance and effect the service of Warrant/s of Seizure and Detention against smuggled motor vehicles, or apply for judicial warrant when necessary;

3.2.5. Effect seizure and recommend forfeiture of motor vehicles pursuant to Section 2536 of the TCCP;

3.2.6 Shall organize AS-U-MOVE Sub-units, upon approval of the Commissioner, in areas identified as hot zones and in the outports whenever warranted;

3.2.7. Issue other internal guidelines that are necessary to effectively enforce the objectives of this Order; and

3.2.8. Perform such other functions as may be directed by the Commissioner.

IV. REPEALING CLAUSE:

All rules, regulations, orders and other issuances inconsistent herewith are hereby deemed repealed, superseded or modified accordingly.

V. EFFECTIVITY:

This Order shall take effect immediately.
