ADDITIONAL GUIDELINES IN THE IMPLEMENTATION OF P.D. 1221



Please be Informed that the Maritime Industry Board in its meeting on 30 October 1986 has approved additional guidelines in the implementation of P.D. 1221.

Henceforth, the following additional guidelines shall govern the drydocking, repair, improvement, alteration, reconditioning, or conversion of Philippine owned and registered vessels under P.D. 1221, to wit:

1.  All shipowners/bareboat charterers of Philippine registered vessels shall submit to MARINA within thirty (30) days from receipt hereof and every year thereafter a list of their Philippine-registered vessels and trading areas, together with the corresponding schedule for drydocking, repairs or works to be done on said vessels.

2.  No waiver under P.D. 1221 shall be issued to an applicant therefor, until after he shall have duly notified MARINA in writing, at least thirty (30) days prior to the scheduled date of drydocking, repair, improvement, alteration, reconditioning or conversion of vessel, of the exact position and location/port of the said vessel immediately before said date.

3.  After a waiver shall have been issued, the shipowner/bareboat charterer shall submit to MARINA a full report of the actual costs of drydocking, repair, improvement, alteration, reconditioning, or conversion of the vessel, within fifteen (15) days from the date the same shall have been completed.

4.  A waiver shall be issued strictly to cover only one (1) specific vessel and may be used only once in accordance with its terms and conditions.

5.  Any violation of or non-compliance with the provisions of this Circular shall be subject to the provisions of Rule VI of the Rules and Regulations Implementing P.D. 1221.

This Memorandum Circular shall take effect immediately.
