PRESCRIBING THE CONFIRMATORY DRUG TEST FEE TO BE PAID BY THE SCREENING DRUG TESTING LABORATORIES TO THE DEPARTMENT OF HEALTH (DOH) ACCREDITED CONFIRMATORY LABORATORIES



Pursuant to the powers vested in the Dangerous Drugs Board under Section 81 (b), Art. IX of RA 9165, otherwise known as the "Comprehensive Dangerous Drugs Act of 2002", in compliance with the decision of the Board arrived at during its 71st Meeting on March 12, 2004, the DDB hereby prescribes the following rules and regulations:

Section 1. Coverage - The screening drug testing laboratories accredited by the Department of Health shall be charged the herein prescribed fees, which should be accepted by all the confirmatory drug testing laboratories.

Section 2. Fees - The confirmatory laboratories shall only charge a maximum of One Thousand Pesos (P1,000.00) for every screened positive urine sample submitted.  The fee shall be the same regardless of the metabolites of methamphetamine/MDMA (amphetamines) and cannabis sativa/marijuana (tetrahydrocannabinols) being detected.

Section 3. Administrative Sanctions - Subject to existing rules and regulations and after due notice, any confirmatory drug testing laboratory found to be charging fees higher than the herein prescribed amount shall suffer any of the following sanctions, to wit:
a.  1st offense - Reprimand
b.  2nd offense - Suspension of the License to Operate for 30 days
c.  3rd offense - Revocation of the License to Operate

Section 4. Effectivity - This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after registration with the Office of the National Administrative Register (ONAR), U.P. Law Center, Quezon City.
