TURN OVER OF DETAINEES TO THE VARIOUS CITY, PROVINCIAL AND MUNICIPAL JAILS IN METRO MANILA AND ENVIRONS



On 15 August 1990 Memorandum Order No. 45 was issued to hasten turn over of detainees to the various City, Provincial and Municipal Jails in Metro Manila and environs and likewise decongest our over populated detention facilities.

It has been observed that there has been no faithful compliance to this order and the problem of congestion has turned from bad to worse.

Henceforth, the arresting Agents and their immediate chiefs are directed to furnish immediately the jail officers the required papers and documents to enable the turn over of the detainees to the appropriate Municipal or City Jails.  If after the lapse of three days the Agents/Chiefs concerned have not complied with this requirement the suspect or accused will be returned to them for custody and turned over by them to the jail concerned.

Excepted from this period are instances where the suspect waives arbitrary detention wherein preliminary investigation has to be conducted by the Prosecutor within seven days.  Upon filing of the information the suspect must be turned over to the City or Municipal Jail immediately.

Deviation or exception to this Memorandum must be cleared or approved by the Director, Assistant Director or Deputy Director for investigation.

Failure to comply with the instructions set forth in this Memorandum will be meted penal administrative sanctions.

Strict compliance is enjoined.
