[ LTFRB MEMORANDUM CIRCULAR NO. 94-009, June 22, 1994 ]

COMPLIANCE WITH THE TEMPORARY RESTRAINING ORDER ISSUED BY THE SUPREME COURT IN G.R. NO. 115381



In compliance with the Temporary Restraining Order (TRO) issued by the Honorable Supreme Court in G.R. No. 115381 (Kilusang Mayo Uno Labor Center vs. Hon. Jesus B. Garcia, Jr., Land Transportation Franchising and Regulatory Board and PBAOP, its Officers and affiliated organizations) it is hereby directed that:

1.  the increased fares for ordinary/regular provincial buses implemented by the PBOAP members as well as those of its affiliated organizations and other bus operators similarly situated are rolled back to the fares duly authorized by this Board in its decision dated December 14, 1990 in Case No. 90-4794;

2.  all proceedings conducted by this Office and Regional Offices including the issuance of Certificates of Public Convenience under and in accordance with DOTC Department Order No. 92-587 and LTFRB Memorandum Circular No. 92-009 are suspended until further orders.

Until the Honorable Supreme Court has resolved the issues raised and has promulgated its resolution/decision in G.R. No. 115381, strict compliance with the Temporary Restraining Order is hereby directed.
