[ CPA MEMORANDUM CIRCULAR NO. 06-2010, June 16, 2010 ]
IMPLEMENTING RULES AND REGULATIONS ON THE MANDATORY WEIGHING OF ALL OUTBOUND LOADED DOMESTIC CONTAINER VANS AT THE BASEPORT OF CEBU (CPA A.O. 01-2010)
Pursuant to R.A. 7621 (The Charter of Cebu Port Authority), the following implementing rules and regulations of CPA Administrative Order No. 01-2010 (Mandatory Weighing of All Outbound Loaded Domestic Container Vans at the Baseport of Cebu)
are hereby prescribed for the guidance and compliance by all concerned:
Section 1. This memorandum circular shall be known as the CPA Implementing Rules and Regulations on the Mandatory Weighing of All Outbound Loaded Domestic Container Vans at the Baseport of Cebu.APPROVED.
Section 2. No outbound loaded domestic container van shall be allowed entry into the Cebu Baseport without a duly validated weigh slip/receipt from accredited weighing scale operator/s.
Section 3. Guidelines. All outbound loaded domestic container vans at the Baseport of Cebu shall observe the following rules:
|3.1 ||All outbound containers for loading onto a carrying vessel shall be subject to mandatory weighing at the Cebu Baseport to ensure compliance with the Allowable Container Weight and Prescribed Gross Vehicle Weight;|

|3.2|| Overloaded containers shall not be loaded onto the carrying vessel unless measures to correct the same have been done. However, these measures such as stripping, attendant special services and ultimate withdrawal of these cargoes that may be provided by the cargo handling operator are for the account of the cargo/vehicle owner;|

|3.3 ||Any existing weighbridge operator/s and those offering their weighing services to outbound cargoes at the Baseport shall apply for accreditation with the Authority. Only weigh slips/receipts of accredited weighbridge operators shall be honored;|

|3.4|| Pending accreditation of other weighbridge operators, the existing weighbridge being operated by OPASCOR shall be used;|
| || |
|3.5 ||Payment for the use of the Weighbridge/Truck Scale shall be the rates as agreed upon by the service provider and the owner of the cargo/vehicle and as approved by the CPA for weighing scale operators within the port zone.|
| || |
|3.6 ||The service provider/operator within the port zone shall remit to the Authority the corresponding government share or variable fee out of its gross income from the weighing service operation in addition to the Permit to Operate Fee per annum.|
| || |
|3.7 ||The cargo handling operator shall, whenever necessary and expedient, coordinate with the Authority any concern resulting from the mandatory weighing of cargoes/ containers and for the efficient implementation of this Order.|
Section 4. Requirements for Accreditation of Weighbridge Scale Operator. Weighbridge scale operators offering their services to outbound cargoes for loading at the Baseport shall submit the following requirements for accreditation with the Authority:
|4.1 ||Letter of intent|
|4.2 ||DTI or SEC Business Name Registration, as the case may be|
|4.3 ||Certificate of Calibration from the Regional Standards and Testing Laboratory of the Department of Science and Technology (DOST) issued within the last six (6) months;|
|4.4|| Schedule of Rates|
|4.5|| Power generator set|
Section 5.Allowable Load Limit. The allowable load limit for cargo shall be 18 tons while the gross weight for container vans shall be 20.5 tons per TEU.
Section 6. Proof of Scale
6.1 All outbound loaded domestic container vans weighed by an accredited weighing operator shall be issued with a validated weighing slip, containing the following details:
6.1.1 Truck Plate Number
6.1.2 Truck Owner
6.1.3 Total Weight (truck, chassis and cargo)
6.1.4 Truck/Chassis Weight (TARE)
6.1.5 Container/Cargo Weight
6.1.6 Container Number
6.1.7 Amount Paid
6.2 The truck driver shall be furnished with two (2) copies of the validated weighing slip as proof of scale to be submitted as follows:
|6.2.1 ||First copy – All entry gates at the Domestic Zone (for all containers and cargoes that would enter the Baseport)|
|6.2.2 ||Second copy – Truck driver (owner’s copy)|
Section 7. No Scale, No Entry. No container or other cargo (on truck) for loading to vessels shall be allowed entry at any of the Domestic Zone gates without a validated weighing slip issued by an accredited weighbridge operator.
The Trucker’s Way Bill, if any, shall be stamped “WEIGHED” and validated by the concerned CPA representative for Baseport Gate’s control purposes.
Section 8. Responsibilities of Concerned Personnel
8.1 Baseport gates – the Gate Guard shall perform the following:
|8.1.1|| Ask for a copy of the validated weighing slip from the truck driver;|
|8.1.2|| Check the validated Trucker’s Way Bill for authentication;|
|8.1.3|| See to it that the validated weighing slip is issued by an accredited weighbridge operator and not fabricated or used twice by the truck driver in entering the Baseport;|
|8.1.4 ||Receive instructions from CPA Port Security Safety and Environment Department (PSSED), Port Manager/Operations and Personnel for control purposes.|
8.2 Summary Report. At the end of every shift, all collected weighing slips shall be submitted to the Port Management Office concerned for summary and reconciliation.
Any discrepancies noted during the reconciliation process shall be investigated promptly.
Section 9. Separability Clause. – In the event that any provision of this Circular is declared invalid by competent court or authority, the remaining provisions to which such declaration does not relate shall continue to be valid and in full force and effect.
Section 10. Effectivity – This Memorandum Circular shall take effect immediately.
