PROVIDING ASSISTANCE IN THE ENFORCEMENT OF TRAINING CONTRACTS BETWEEN CONSTRUCTION COMPANIES AND THEIR WORKERS



In order to ensure that the construction industry remains viable relative to its development objectives and to safeguard the welfare and interest of workers in the industry, the Department of Labor and Employment, through the Philippine Overseas Employment Administration (POEA) shall assist in the enforcement of training Contracts between construction companies and their workers.

The Philippine Overseas Employment Administration shall put on hold the processing of overseas work contracts of workers who are covered by valid training contracts with specific "in-service" cost recovery periods. The list of workers with valid training contracts shall be submitted to the POEA by the Philippine Constructors Association (PCA), through the Construction Manpower Development Foundation (CMDF).

The National Manpower and Youth Council (NMYC) shall assist the industry in the task of developing and upgrading manpower for the sector. Together with PCA, CMDF and POEA, the NMYC shall formulate a set of criteria upon which a regular listing of critical skills shall be based. Such a list of critical skills shall be the basis for further intervention by POEA and NMYC, together with their industry partners, in promoting the welfare of workers and employers in the construction industry.

This order shall take effect after fifteen (15) days from the date of publication in two (2) newspapers of general circulation.
