CLARIFICATORY GUIDELINES ON PILOTAGE/TUG ASSISTANCE



To ensure a more effective and uniform implementation of PPA pilotage/tug assistance regulations, the following clarificatory guidelines are hereby issued for the guidance of and compliance by all concerned:

1. Pilotage service shall be compulsory in government and private ports for all foreign vessels and for domestic vessels of 100 GRT and above.

2. Considering that Executive Order No. 1088 has been declared valid by the Supreme Court, pilotage rates prescribed therein (Annex "A"*) shall be strictly implemented.

3. The "No Service, No Pay" policy should be enforced and adhered to by all concerned. In no instance shall any harbor pilot charge or bill any vessel for pilotage service which should have been rendered but which, in reality, was not undertaken. In this regard, shipping companies are advised to remind their Masters not to sign pilotage service tickets for unrendered pilotage.

4. Tug assistance is generally optional under normal conditions. However, it is compulsory in the following areas/situations:

4.1 Baseport of Cagayan de Oro — for all foreign and domestic vessels of 1,500 GRT and above (PPA AO No. 12-95);

4.2 Baseport of Nasipit, Port of Masao and Port of Butuan — for all foreign and domestic vessels of 1,000 GRT and above (PPA AO No. 03-96);

4.3 Baseport of Zamboanga — for all foreign and domestic vessels of 1,500 GRT and above (PPA AO No. 04-96);

4.4 Port of General Santos and at other ports within the SOCSARGEN area — for all foreign and domestic vessels of 1,500 GRT and above (PPA AO No. 06-96);

4.5 Ports within the jurisdiction of PMO-Iligan — for all foreign and domestic vessels of 2,000 GRT and above (PPA AO No 12-96);

4.6 Baseport of Ozamis — for all foreign and domestic vessels of 500 GRT and above (PPA AO No. 07-97);

4.7 Baseport of Iloilo and at other ports within the jurisdiction of PMO-Iloilo — for all foreign and domestic vessels of 1,000 GRT and above (PPA AO No. 11-97);

4.8 South Harbor, Port of Manila — for all foreign and domestic vessels of 500 GRT and above (PPA AO No. 06-98);

4.9 When any of the conditions stated in Section 12 of PPA AO No. 03-85 necessitating compulsory tug assistance is present.

5. Existing tug assistance rates in the various ports are shown in Annex "B"*. In the absence of applicable fees, the shipping company and the tugboat operator shall agree on the chargeable rate, after which the same shall be immediately sent to the General Manager, through CSD, for approval and subsequent dissemination.
