[ MTC RESOLUTION NO. 05, S. 1999, October 07, 1999 ]

ESTABLISHING A POLICY ON NON-RECOGNITION OF CERTIFICATES ISSUED BY NON-PARTIES.



WHEREAS, paragraph 4 of Regulation I/10 of 1978 STCW Convention, as amended provides that certificates issued by or under the authority of a non-Party to the STCW Convention shall not be recognized.

WHEREAS, the Philippines as a Party to the STCW Convention is committed to promulgate laws, order, regulations and to take all steps which may be necessary to give the Convention full and complete effect.

BE IT RESOLVED, as it is hereby resolved that the Philippines pursuant to Section 2 (5) of the LOI 1404 shall not recognize the certificates issued by or under the authority of non-Parties.

Be it resolved further that all governmental agencies involved in the implementation of the 1978 STCW Convention, as amended shall take cognizance of the provisions of this Resolution and to take steps to incorporate the provisions, as may be appropriate, in the rules and regulations it may issue or promulgate.
