WHEREAS, the Philippines has been granted a Tariff Rate Quota (TRQ) of 137,353 MTCW for Quota Year 2007-2008;

WHEREAS, as of January 23,2008, only 11:500 MT had been processed for shipment or is ready for shipment and 38,688.28 MT had been verified for U,S, Quota allocation;

WHEREAS, Sugar Order No. 6, Series of 2007-2008 has declared "homeless", the "A" quedans covering sugar production of September 2 to November 25, 2007 which have not been verified for the January 9, 2008 deadlines as stated in the said Sugar Order;

WHEREAS, various sugar producers/traders had made an appeal to the SRA for reconsideration for verification of their "A" export sugar covering sugar production of September 2-November 25, 2007 of crop year 2007-2008 classified as "homeless" sugar pursuant to Sugar Order No'. 6, Series of 2007-2008;

WHEREAS, the SRA is mandated by E.O. 18, Series of 1986, to protect the interest of the sugar industry in general and sugar producers in particular, without compromising our export commitment to the U.S. in terms of quality of the "A" sugar and its shipment schedule;

NOW, THEREFORE, under and by virtue of the powers vested in the Sugar Regulatory Administration {SRA), it is hereby ordered that;

SECTION 1. The "A" sugar quedans covering sugar production of September 2, to November 25, 2007 which were declared as "A" 'homeless1 sugar pursuant to Sugar Order No. 6, Series of 2007-2008 are hereby reinstated as "A" or U.S. Quota sugar.

SECTION 2. The "A" sugar quedans covering the "A" 'homeless' sugar shall be subject for verification prior to its reinstatement as "A" or U.S. Quota sugar.

SECTION 3. The application for reinstatement and verification of the subject "A" quedans shall be filed with the SRA, Quezon City attached thereto the "A" quedans and the corresponding list by mill/by quedan number.

SECTION 4. A reinstatement fee of Php10.00 per LKg-Bag shall be paid upon filing of the application for verification with the SRA.

SECTION 5. AH "A" quedans subject of verification shall be stamped in the back thereof as "Reinstated "A" 'homeless1 sugar into "A" or U.S. Quota sugar per S.O. No. 8, Series of 2007-2008".

SECTION 6. Deadline for reinstatement and verification of "A" quedans (September 2-November 25, 2007 production) covered by this Sugar Order is on February 29, 2008. Thereafter, unverified quedans shall remain expired (homeless).

SECTION 7. Effectivity: This Order shall take effect immediately.

SECTION 8. Consistency. Provisions of Sugar Order, Circular Letter, and/or other rules and regulations contrary to or inconsistent with this Sugar Order, are hereby amended, modified or revoked accordingly,
