PENALTY FOR LATE FILING OF APPLICATIONS/PETITIONS



It has come to the attention of the Board that the extension of time being given for the late filing of applications/petitions for extension of validity of expiring/expired CPC's, substitution of dropped units, extension of time to register authorized units and registration in lieu of authorized units beyond their reglementary periods, as well as charges/penalties being collected for the late filing of the same, vary among the Regional Offices which cause confusion among the operators.

In order, therefore, to have a uniform procedure and policy, the following shall be observed:

1. Only six (6) months extension from the reglementary period (expiry dates) of the CPC's/Orders shall be allowed the operators within which to file the above-stated applications/petitions. This is in accordance with the agreement reached during the Confederation of Land Transport Organizations of the Philippines (COLTOP) meeting.

2. A penalty of P210.00 per case number per month shall be charged/collected for late filing of applications/petitions beyond their reglementary periods.

3. The reglementary periods are as follows:

Type of Application/Petition Reglementary Period
   
a. Extension of CPC - date of expiration of CPC
b. Substitution of Dropped Units - 60 days from receipt of dropping order
c. Registration of Authorized Units - 30 days from receipt of CPC
d. Registration in lieu of authorized units - 30 days from receipt of CPC

This Memorandum Circular shall apply to the types of application/petition mentioned herein and shall take effect fifteen (15) days after the filing of three (3) copies hereof, with the U.P. Law Center pursuant to Presidential Memorandum Circular NO. 11 dated October 9, 1992, in all regional offices of this Board. All Regional Managers are hereby directed to post copies of this circular in conspicuous places in their offices for the public information.

Strict compliance herewith is hereby enjoined.
