AN ORDINANCE REQUIRING ALL BUSINESS ESTABLISHMENTS COVERED BY ORDINANCE NO. 8173, TO ENROLL THEIR SURVEILLANCE SYSTEM WITH THE CITY OF MANILA'S "EMERGENCY RESPONSES ASSISTANCE PROGRAM" BEFORE ITS BUSINESS PERMIT BE ISSUED OR RENEWED

PREAMBLE

WHEREAS, the City of Manila, as a local government unit, is mandated by law to preserve the comfort and convenience of its inhabitants;

WHEREAS, threats from lawless and criminal elements and the danger posed by natural and man-made calamities will always be the challenge that confronts local government officials from its day-to-day activities;

WHEREAS, with the magnitude of people residing, working or just passing through the city, it would be impossible for the city government to make a swift and rapid response in every situation to safeguard the welfare of its constituents;

WHEREAS, to address this pressing issue, the City of Manila must look for a viable solution by adopting the advancement of modern technology for effective, efficient and fast response in every emergency situation, inside the metropolis;

WHEREAS, this program can only be achieved with the support of the business sector in the community which plays a vital role in the continued economic growth and development of the city;

WHEREAS, on November 27, 2008, the City of Manila passed Ordinance No. 8173, entitled: "AN ORDINANCE REQUIRING THE INSTALLATION OF SECURITY CAMERA SYSTEMS IN ALL SHOPPING MALLS/DEPARTMENT STORIES, CONVENIENCE STORES, GASOLINE STATIONS,  PAWNSHOPS, MONEY CHANGERS, AND BANK/FINANCIAL INSTITUTIONS, WITH MINIMUM BUSINESS CAPITAL OF FIVE HUNDERED THOUSAND PESOS (PHP 500,000.00), OPERATING WITHIN THE CITY OF MANILA, TO BE SET UP AT STRACTEGIC LOCATIONS WITHIN THEIR ESTABLISHMENT, AND PROVIDING PENALTIES FOR VIOLATION THEREOF";

WHEREAS, to give more spirit to the intention of the framers of the aforecited Ordinance and to maximize the full utilization of the security camera systems installed all over the city, it is imperative to integrate and/or enroll the same to the City of Manila's Emergency Response Assistance Program: NOW, THEREFORE, Be it ordained by the City Council of Manila, in session assembled, THAT:

SECTION 1. Title. - This Ordinance shall be known as the "City of Manila's Enrollment of Surveillance System".

SEC. 2. Basis. General Welfare Clause. - "Every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare. Within their respective territorial jurisdictions, local government units shall ensure and support, among other things, the preservation and enrichment of culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants." (Section 16, Republic Act 7160)

SEC. 3. Coverage. - This Ordinance shall cover the following:

a) All business establishment mentioned in Ordinance No. 8173;

b) All other business establishments not covered by the next preceding paragraph with a minimum capitalization of Five Hundred Thousand Pesos (PhP 5000, 000.00).

SEC. 4. Mandatory Requirement Before the Issuance or Renewal of Business Permit. - It shall be mandatory for all establishments mentioned in the next proceding section to enroll with City of Manila's Emergency Response Assistance Program as a condition sine qua non before a business permit be renewed or issued.

SEC. 5. Duty of the Office of the Business Permit and Licensing. - The Office of the Business Permit and Licensing is mandated by this Ordinance to issue guidelines necessary to implementing the provisions of this Ordinance.

SEC. 6. Appropriations. - The City of Manila shall appropriate such amount as may be necessary for the initial implementation of this Ordinance.

SEC. 7. Separability Clause. - If, for any reason or reasons, any part or provisions of this Ordinance shall be held unconstitutional or invalid, other parts or provisions, hereof, which are not affected thereby, shall continue to be in full force and effect.

SEC. 8. Amendatory Clause. - All ordinances, rules and regulations that are inconsistent with this Ordinance are hereby amended accordingly.

SEC. 9. Effectivity Clause. - This Ordinance shall take effect upon its approval.

This Ordinance was finally enacted by the City Council of Manila on March 24, 2015.
