REINFORCING THE LEGAL REQUIREMENT ON THE MANDATORY REGISTRATION OF DETAILMEN/ MEDICAL REPRESENTATIVES/PROFESSIONAL SALES REPRESENTATIVES WITH THE PROFESSIONAL REGULATION COMMISSION AND THE PROFESSIONAL REGULATORY BOARD OF PHARMACY

WHEREAS, Section 12 of Republic Act No. 5921, otherwise known as “An Act Regulating the Practice of Pharmacy and Setting Standards of Pharmaceutical Education in the Philippines and for other Purposes” requires all detailmen in any pharmaceutical or drug laboratory and other manufacturers, distributors, dealers or wholesaler of medical, dental, pharmaceutical, biological and veterinary products to register with the Professional Regulatory Board of Pharmacy (Board) in accordance with such guidelines as may be promulgated;

WHEREAS, detailmen, hereinafter referred to as medical representatives or professional sales representatives, are individuals who represent any duly authorized drug establishment for the purpose of promoting the company’s products to duly licensed professionals;

WHEREAS, drug establishment refers to any organization or company involved in the manufacture, importation, repacking and/or distribution of drugs or medicines, as defined under DOH Administrative Order No. 56. Series of 1989;

WHEREAS, as early as 1977, the Board has already issued a Memorandum Circular (M.C.) requiring medical representatives or professional sales representatives employed by drug establishments to possess the necessary credentials set by the Board;

WHEREAS, the Board issued Resolution No. 2004-07 prescribing the requirements and procedures on the registration of medical representatives or professional sales representatives with the Commission and the Board;

WHEREAS, pursuant to this Resolution, an applicant for registration as medical representative or professional sales representative must have undergone a comprehensive training program conducted by a training provider duly accredited by the Board;

WHEREAS, the Commission and the Board have received minimal number of such applications for accreditation of training programs and providers for the past years;

WHEREAS, there are many pharmaceutical and other similar entities in the country which employ medical representatives or professional sales representatives without complying with the requirements of the law;

NOW THEREFORE, in view of the urgent need to reinforce the legal requirement on the mandatory registration of all medical representatives or professional sales representatives with the Commission and the Board, the following are hereby RESOLVED:

(1)
To promulgate the Revised Guidelines on the Registration of Medical Representatives or Professional Sales Representatives with the Commission and the Board which shall be made as an integral part of this Resolution as Annex A;
(2)
To issue another M.C. directing all drug establishments to require all medical representatives or professional sales representatives under their employ to register with the Commission and the Board subject to the provisions of this Resolution and the Revised Guidelines; and
3)
To instruct the Standards and Inspection Division (SID) to accept applications for accreditation of training programs and providers as well as applications for registration as medical representatives or professional sales representatives. Provided, that medical representatives or professional sales representatives who have not undergone the prescribed training programs from accredited providers shall be allowed to apply for registration until June 30, 2015 only, and after which, only those who have complied with the training requirements and standards as set forth in the Revised Guidelines shall be registered by the Commission and the Board.


Let copies of this Resolution be published in the Official Gazette or in any newspaper of national circulation and furnished the U. P. Law Center, Philippine Association of Pharmacists in the Pharmaceutical Industry (PAPPI), Philippine Pharmacist Association Inc. (PPhA), Standards and Inspection Division and all other agencies/offices for information and dissemination.
