ANTI-JAYWALKING IN METROPOLITAN MANILA AND PROVIDING PENALTY THEREFOR



WHEREAS, among the scope of services vested by law to the Metropolitan Manila Development Authority (MMDA) is traffic management which includes the institution of a system to regulate road users in metropolitan Manila;

WHEREAS, the Metro Manila Council (Council) is aware that jaywalking is one the factors that contribute to traffic congestion in Metropolitan Manila;

WHEREAS, the MMDA, in its desire to improve the traffic flow in Metropolitan Manila agreed, in session duly assembled, to enact an Anti-Jaywalking Ordinance;

NOW THEREFORE, be it ordained by the Council, pursuant to Section 6 of RA No. 7924 that;

SECTION 1. Jaywalking Defined — For purposes of this Ordinance, jaywalking shall mean any of the following acts;

a) Crossing the street, thoroughfare or highway outside the marked cross-walk or pedestrian crossing, or underneath a pedestrian overpass, and in the absence of such mark, crossing the street, thoroughfare or highway except at the corner of intersection, as nearly as possible at the right angle perpendicular to the intersection;

b) Crossing the street, thoroughfare, or highway, even within the marked cross-walk or pedestrian crossing without conforming with the hand signal of the policemen or traffic enforcer assigned at the intersection or contrary to the signal by other devise for regulating traffic; and

c). Walking outside the sidewalk of a street, thoroughfare or highway so as to inconvenience, obstruct, hinder or prevent free passage of vehicles.

SECTION 2. Coverage — Jaywalking as defined in Section 1 is hereby declared unlawful and shall apply to all cities and municipalities of Metropolitan Manila.

SECTION 3. Repealing Clause — This Ordinance shall not be construed as an amendment the existing Anti-Jaywalking Ordinance of the Cities and Municipalities of Metropolitan Manila, but shall be supplemental thereto.

SECTION 4. Penalty — Violation of this Ordinance shall be penalized by a fine of P100.00 and /or community service of one day or less at the discretion of the court.

SECTION 5. Effectivity — This Ordinance shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation in Metro Manila.
