[ REVISED RULES AND REGULATIONS GOVERNING PEDICAB OPERATIONS IN INTRAMUROS, January 18, 2018 ]

PURSUANT TO THE PROVISIONS OF PRESIDENTIAL DECREE 1616 AND ITS IMPLEMENTING RULES AND REGULATIONS, THE FOLLOWING RULES AND REGULATIONS ARE HEREBY PROMULGATED TO GOVERN THE OPERATIONS OF PEDICAB IN INTRAMUROS.

CHAPTER I
DEFINITION OF TERMS


Section 1. Definition of Terms - When used in these Rules, unless the context otherwise indicates, the following terms shall mean as follows:
a. DOT - Department of Tourism
b. Driver - a person accredited/authorized  to drive the pedicab
c. lA - Intramuros Administration
d. Operator - owner of the Permit to Operate and Pedicab.
e. Pedicab - a three-wheeled local transport
f. Pedicab Permit - issued by the lA officially recognizing the holder as having complied with the minimum standards and requirements prescribed for the operation and maintenance of pedicab.
CHAPTER II
REQUIREMENTS FOR PERMIT TO OPERATE/ACCREDITATION


Section 1. Who May Apply. A Filipino citizen and resident of barangay  within the  Intramuros,  who  is  at  least  eighteen  (18)  years  of  age,  physically  and mentally  fit and of good  moral  character  may apply  to operate  and/or  drive  a pedicab within Intramuros.

An operator is allowed only one (1) pedicab and a maximum  of two (2) drivers which he/she is included or counted.

Section  2.  Documentary   Requirements   for  Both  Pedicab  Operator  and Driver. The applicant will submit yearly the following documents to the lA:
a.    Accomplished Application Form
b.    Two (2) pieces of 2” x 2: colored ID photo in white background
c.     Barangay’s Certificate of Endorsement to operate or drive pedicab d.     Photocopies of NBI Clearance and Government ID; and
e.    Negative  Results  of  Standard  Drug  Testing  from  Accredited  Government
Hospitals.
Requirements  will  be  submitted  to  lA-Urban  Planning  and  Community Development Division (UPCDD) for evaluation. Upon approval of application and payment of necessary fees provided in next Section 4, operator will be given the pedicab permit and driver's ID.

Section  3. Fees. An annual fee of One Thousand  Pesos (P1,000.00)  shall be paid by an applicant to cover the pedicab’s permit, sticker and one (1) Driver’s ID. A fee of One  Hundred  and  Fifty  Pesos  (P150.00)  will be charged  for the second Driver’s ID.

Section 4. Limits on Issuance of Pedicab Permits.
Upon assessment and validation by lA of Intramuros’ traffic management, it will set, approve and issue a maximum number of permits to operate yearly. This is to give lA the proper management of the traffic and mobility of people and transportation inside the Intramuros.

CHAPTER III
ROUTES, TERMINALS AND FARES


Section  1. Routes. Pedicabs  are allowed on all streets except for Magallanes Drive, Andres Soriano, Muralla, General Luna, Urdaneta, Sta. Lucia and Real (portion between Cabildo and Gen. Luna).

Section 2. Operating Hours. Operation of Pedicabs shall be from 06:00 a.m. to 09:00 p.m. A maximum of two (2) passengers are allowed to ride the pedicab at one time.

Section 3.Terminals. Each barangay will have designated terminals exclusively for pedicabs from the barangay. Only twelve (12) pedicabs are allowed to park at the terminal at any time (Annex A). Below are the initial designated terminals:
Bgy.654     - Anda cor. Muralla (7-11 side)
                  - Anda Gap to P. Burgos Drive (ASEAN Gardens side)
                  - San Juan de Letran (side of LPU Gym)

Bgy.655     - Sto. Tomas cor. Cabildo (side of green fence structure)
                  - Solana cor. Beaterio
                  -  Arzobispo   cor.  Andres  Soriano  Ave.  (side  of  Palacio  del Gobernador)

Bgy.656     - Aduana (after Aduana Gap and Petron side)
                  - Solana cor. Andres Soriano Ave. (BF Condo side)

Bgy. 657     - San Jose cor. Gen. Luna (DOLE side)
                   - Victoria cor. P. Burgos Drive (Recoletos side)
                   - Recoletos (Manila Bulletin side)

Bgy.658     - San Francisco cor. Muralla (Lyceum side)
                  - CabiIdo cor. Sta. Potenciana (Seaman’s Center side)
                  - Victoria cor. P. Burgos Drive (Recoletos side)
The lA may change the designated terminals when necessary thru an issuance or a circular notifying the pedicab operators/drivers.

Section 4. Fares. The pedicab operator/driver  shall charge only such fares for his services as may be approved or fixed by lA.

CHAPTER III
PEDICAB DESIGN/STRUCTURE


Section 1. Design. The Operator shall follow the color and design prescribed by lA. Horns, radios and similar accessories to be installed are strictly prohibited.

Section  2.  Display  of  lA  Sticker  and  Tariff.  UPCDD  staff  will  affix  the  lA pedicab  sticker  on the front portion  of the pedicab.  While  the Tariff Rate duly issued to the operator shall be displayed in a conspicuous place.

CHAPTER IV
OBLIGATION OF OPERATOR AND/OR DRIVER


Section 1. Operator/driver shall wear the uniform prescribed by lA. Shorts and slippers are not allowed. Proper hygiene should always be observed.  Smoking while driving is prohibited.

Section  2. Smoking,  gambling  and  drinking  alcohol  at pedicab  terminals  and while driving are strictly prohibited.

Section   3.  Parking   on  the  streets   and  sidewalks   beyond   the  terminal   is prohibited.

Section  4.  Drivers  and  operators  shall  undergo  frontline  services  training  by
DOT.

CHAPTER VI
GROUNDS FOR CANCELLATION OF PEDICAB PERMIT


Section 1. Grounds for the Cancellation of Permit to Operate. Any of the following acts or omissions shall be sufficient grounds for the suspension or revocation of permit:
a.     Making  any  false  declaration  or  statement  or  making  use  of  any  such declaration   or   statement   or   any   document   containing   the   same;   or committing fraud or any act of misrepresentation  for the purpose of obtaining the grant of accreditation  provided  that the cancellation  of accreditation  as herein stated shall be without prejudice to any action which may be initiated against the violator.
b.     Failure  to  maintain  the  standards  and  requirements  for  accreditation  as prescribed in these rules;
c.     Violation  of  or  non-compliance  with  any  of  the  provisions  of  these  rules, promulgated  orders, decisions  and circulars issued by the Department  and other concerned government agencies;
d.     Promoting,  facilitating  or  conducting  activities  constituting  prostitution  or other  illegal  undertakings  as part  of a tour  for both  foreign  and  domestic tourists;
e.    Gross  and  evident  bad  faith  in  dealing  with  passengers   or  fraudulent
solicitation of business;
f.     Allowing an individual without lA Identification Card to drive the pedicab. g.     Plying routes other than those designated by lA;
h.    Any act of fare overcharging committed by the driver;
i.     Any act of discourtesy by the driver to the passenger; and
j.     Any other act or omission inimical to the interest of the tourism industry.
Section 2. Violation/s of the rules shall warrant the following penalties:
•  First  Offense  - Suspension  of Permit  to  Operate  for  5 days  and  a fine  of
P500.00
•  Second Offense - Suspension of Permit to Operate for 10 days and a fine of
P1,000.00
•  Third Offense - Revocation of Permit to Operate for one (1) year.
•  Pedicabs  operating  without  permits  or with fake or borrowed  permits  will be immediately confiscated.
•  Permits  of pedicab  operators  who  allow  its  use  by  other  individuals  will  be revoked immediately.
CHAPTER VIII
MISCELLANEOUS PROVISIONS


Section   1.   Confidential   Character   of   Data.   Information   and   documents received or filed with the lA in pursuance of the requirements of these Rules shall be  treated  as  confidential  and  shall  not  be  divulged  to  any  party  without  the consent of the applicant concerned.

Section  2. Separability  Clause.  The provisions  of these Rules are separable and should any of said provisions or part thereof be declared invalid, the validity of all the other provisions shall not be affected by such declaration.

Section  3.  Repealing  Clause.  All  existing  memorandum  circulars,  orders  or rules and regulations issued by the Department  of Tourism and/or lA which are inconsistent   with  the  provisions  of  these  rules  and  regulations   are  hereby repealed and/or modified accordingly.

Section 4. Effectivity. This revised rules and regulations shall take effect upon approval of the Intramuros’ Board of Administrators and fifteen (15) days after publication in the Official Gazette or in a newspaper of general circulation in the Philippines.
