AMENDING PROCLAMATION NO. 20, S. 1926 WHICH RESERVED CERTAIN PARCEL OF LAND SITUATED IN THE CITY OF DAVAO FOR WIRELESS STATION PURPOSES BY EXCLUDING FROM ITS OPERATION THE UNUTILIZED PORTIONS OF THE LAND EMBRACED THEREIN AND DECLARING THE SAME OPEN FOR DISPOSITION IN FAVOR OF THE ACTUAL OCCUPANTS UNDER THE PROVISIONS OF THE PUBLIC LAND ACT, AS AMENDED
Upon the recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 20 dated March 23, 1926 which reserved certain parcel of land situated the City of Davao, Island of Mindanao for wireless station purposes, by excluding from its operation the unutilized portions of land embraced therein and declaring the same open for disposition under the provisions of the Public Land Act, as amended, subject to private rights, if there be any, which portions of land are more particularly described as follows;

Bounded on the Northeast, along line 46-47, by Lot 478; on the Southeast, along Line 47-1 by Lot 527, both of Cad-102; on the Southwest, along lines 1-2 by Lot 8704-B, Csd-11-015292-D; along lines 2-3-4-5 by Lot 8703, Cad-102 (Lot 1100-A, Csd-11-006593-D) along lines 5-6-7-8-9-10-11-12-13-14-15-16, on the Northwest, along line 16-17 both by Road Lot 8704, (20,00 m. wide); along lines 17-18-19-20 by Lot 8704-D; along lines 21-22-23-24-25-26-27-28 by Lot 8704-C; along lines 28-29-30-31-32-33-34-35-36-37-38-39-40-41-42-43 by Lot 8704-D, along lines 43-44-45 by Road Lot 8704-E, (20.00 m. wide), all of Csd-11-015392-D; along line 45-46 by Lot 478, Cad-102.

beginning, containing an area of TWENTY SIX THOUSAND ONE HUNDRED THIRTY ONE (26,131) SQUARE METERS, more or less.
All corners marked old Pls/BL cyl. Conc. Mons. 15 x 60 cm. And the rest are PS. Bearings true. Date of original survey February 1916 to May 1920. Date of subdivision survey July 26-31, 2003 and approved on August 8, 2003 and the survey executed by Geodetic Engineer Bernardino C. Magno.

An Inter- Agency Committee (LIAC), composed of representatives from HUDCC as Chaor, the City Government of Davao, DENR, PCUP, and the people’s organization in the area as members is hereby created to immediately prepare the implementing rules and regulations (IRR) of this proclamation.
Except in favor of the government or any of its branches or agencies, all land disposed under this proclamation shall not be subject to alienation and encumbrance for a term of ten years from the issuance of the title in case of sale or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period, but the improvements of the land maybe mortgaged to qualified persons, associations or corporations.
