RESERVING CERTAIN PORTIONS OF THE MILITARY RESERVATION LOCATED IN BRGY. AIRPORT VILLAGE, CATARMAN, NORTHERN SAMAR, FOR SOCIALIZED HOUSING SITE PURPOSES AND DECLARING THE SAME OPEN FOR DISPOSITION IN FAVOR OF THE ACTUAL OCCUPANTS
Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby reserve certain portions of the military reservation located site purposes and declare the same open for disposition in favor of the actual occupants thereof in accordance with the provisions of Republic Act No. (RA) 7279, known as the Urban Development and Housing Act, subject to private rights, if any there be, and to final survey, which portions of land contain a total area of Thirty Thousand Five Hundred One (30,501) square meters.
The parcels of land covered by this Proclamation shall be surveyed in coordination with the Department of National Defense and segregated from the coverage of Transfer Certificate of Title (TCT) No. 0-2539-160 issued in the name of the Commonwealth of the Philippines.
The area herein reserved for socialized housing purposes shall be disposed of in accordance with the provisions of RA 7279, and shall be under the administration of the National Housing Authority (NHA).
For this purpose, and Inter-Agency Committee with HUDCC as Chair, the Municipality of Catarman as Vice-Chairman, with representatives from the NHA, Department of National Defense/Armed Forces of the Philippines, Department of Environment and Natural Resources, Presidential Commission for the Urban Poor and the People’s Organization in the area, as members, is hereby created to formulate implementing rules and regulations of this proclamation.
Such part or parts of the area herein declared as housing site which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the Government or any of its branches or agencies, all lands disposed of pursuant to this proclamation shall not be subject to alienation and encumbrance for a period of ten (10) years from the issuance of the title, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of the said period. Improvements on the land, however, may be mortgaged to qualified persons, associations, partnerships or corporations.
The National Housing Authority shall reimburse the National Government the value of the land after the final payment of the areas reserved for housing purposes by the qualified beneficiaries.
