AMENDING PROCLAMATION NO. 361, S. 1994, ESTABLISHING THE MARITIME COMMUNICATIONS PROJECT SITE, SITUATED IN LOWER BICUTAN, TAGUIG, METRO MANILA, BY SEGREGATING A PORTION THEREOF AND DECLARING THE SAME HOUSING SITE OF EMPLOYEES OF THE DEPARTMENT OF TRANSPORTATION AND COMMUNICATIONS AND ITS ATTACHED AGENCIES



Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL – ARROYO, President of the Philippines, do hereby amend Proclamation No. 361, dated April 17, 1994, which established the DOTC Maritime Communication Project Site located in Lower Bicutan, Taguig, Metro Manila, by segregating a portion of the land embraced therein and declaring the same as housing site of the employees of the Department of Transportation (DOTC) and Communications and its attached agencies, subject to private rights, if there be any, and to final survey, which parcel of land is more particularly described as follows:

Beginning at a point marked "1" on the plan being S. 23 deg. 09’ W. 26202.45 m from BLLM No. 1, Taguig Cad. Mapping, Mcadm-590-D; thence:

beginning, containing an area of TWENTY TWO THOUSAND NINE HUNDRED EIGHTY SEVEN (22,987) SQUARE METERS, more of less

The land subject hereof shall be disposed by the National Housing Authority (NHA) in coordination with the DOTC. Its disposition shall be undertaken under previous schemes, which shall not be limited to those involving transfer of ownership in fee simple, but shall include lease, with option to purchase, usufruct or such other variations as may be deemed expedient by the implementing agencies or bodies.

The DOTC is hereby required to include in the implementation of the proclamation its plan for the two (2) transmitter/receiver antennas found in the area herein reserved, which must be cleared with the National Center for Health Facility Development, Department of Health.

The Proclamation is subject to the minimum road right of way requirements of the Department of Public Works and Highways pursuant to Executive Order No. 621.

The Secretary of Environment and Natural Resources is hereby authorized to issue a Special Patent covering the area herein reserved for housing purposes in favor of the NHA.

The NHA shall reimburse the national government the value of the land after the final payment of the areas reserved for housing purposes by the qualified beneficiaries.
