[ DA MEMORANDUM ORDER NO. 6, July 17, 1996 ]

AUTHORIZING THE DIRECTOR OF ANIMAL INDUSTRY AND REGIONAL DIRECTORS TO ENTER INTO NEGOTIATED CONTRACTS FOR THE PURCHASE OF ANIMALS UNDER THE GINTONG ANI BARANGAY LIVESTOCK BREEDING LOAN PROGRAM (BLBLP)



One of the important components of the Department’s Gintong Ani For Livestock is the Barangay Livestock Breeding Loan Program (BLBLP).

In order to facilitate the implementation of this program, the Director of Animal Industry and all Regional Directors are hereby authorized to enter into negotiated contracts for the purchase of animals under the BLBLP program, as an exception to the provision of GMO No. 1, as amended, subject to the following conditions:

1.         The animals to be purchased shall comply with the specifications and cost estimates (Standard Prices) prepared by the BLBLP National Management Committee in the guidelines entitled “Procedures in the Procurement of Stocks for Barangay Livestock Breeding Loan Program (BLBLP) Thru Negotiated Transaction” which is made part of this Memorandum Order and Identified as “Annex A” * ; Provided, however, that where the amount involved in any purchase exceeds P3.0M, the Requisition and Issue Voucher (RIV) shall be subject to the prior approval of the Office of the Secretary (OSEC) and the total or overall cost of all purchases made by the bureau or region must not exceed the fund allocated to it for the purpose; and

2.         The negotiated purchase must adhere to the procedure outlined “Annex A” * but must be resorted to only if the standard government requirement of public bidding is not feasible and resort to negotiated purchase is justified under the provisions of Executive Order No. 301 dated July 26, 1997, most especially letters (b), and (e) thereof, quoted as follows:
“b.     Whenever the supplies are to be used in connection with the project or activity which cannot be delayed without causing detriment to the public service; and

e.       In case where it is apparent that the requisition of the needed supplies through negotiated purchase is most advantageous to the government to be determined by the Department Head concerned..”
The exercise of the authority herein granted should always be preceded by a canvass of the marker to secure the best quality at a fair and most equitable price for the government.

This Memorandum Order shall take effect immediately.
