[ DDB BOARD REGULATION NO. 1, S. 1998, September 24, 1998 ]

REGULATION GOVERNING THE ESTABLISHMENT OF DANGEROUS DRUGS PROFILING LABORATORY



Pursuant to the powers vested in the Dangerous Drugs Board, under Section 36 (e), Article VIII of RA 6425, as amended, and in accordance with the Decision in its 338th Meeting on 22 January 1998, the Dangerous Drugs Board hereby prescribes the following rules and regulations:

SECTION 1. The Dangerous Drugs Board recognizes the results of scientific studies that dangerous drugs contain traces of impurities which produce specific chemical profiles. This chemical profile may be used to characterize seized samples with respect to their origin and/or mode of manufacture. The different Drug Law Enforcement Agencies can utilize the data on chemical profiles to be able to determine whether two or more separate samples come from a common source or not. It may establish a probable manufacturing process of production that may point to a likely geographical origin. Establishing the origin of a confiscated batch of dangerous drugs will help prevent its unscrupulous pilferage.

SECTION 2. The Dangerous Drugs Board hereby establishes a Network of Dangerous Drugs Profiling Laboratories (DDPLs) composed of existing laboratories of the Dangerous Drugs Board (DDB), National Bureau of Investigation (NBI), Philippine National Police Crime Laboratory (PNPCL).

SECTION 3. The Network of DDPLs shall have the following duties/functions:
  1. To gather and store data pertaining to dangerous drugs.

  2. To assist law enforcement agencies via expert opinion, training and analytical services.

  3. To serve as reference laboratory in dangerous drugs analysis.

  4. To engage in research and development activities which will help update the other network laboratories like instrumentation, validation of protocols, updating the procedures and the like.

  5. To serve other tasks relating to dangerous drugs profiling.
SECTION 4. The Network of DDPLs shall be under a Management Committee composed of members of the Drug Testing Accreditation Committee embodied in Board Regulation No. 1, s. 1995. The Deputy Executive Director of the Dangerous Drugs Board shall be its Chairman.

The members of the Drug Profiling Management Committee shall designate at least two (2) Chemists from their respective laboratories to man each of the Drug Profiling Laboratories. The salaries and allowances of the said Chemists shall be borne by their respective mother agencies.

SECTION 5. The Committee may request a representative from other Law Enforcement Agencies and Non-Government Organizations (NGOs) to attend its meeting as invited resource persons.

SECTION 6. The Committee shall meet at the Dangerous Drugs Board at least twice a month or as often as it may be deemed necessary.

SECTION 7. The Members and Resource Persons present shall each receive an honorarium in the amount of P500.00 per meeting.

SECTION 8. The DDPLs shall be equipped with the necessary equipment/facilities such as Fourier Transform-Infra Red Spectrometer, U.V.-Vis Spectrometer, Gas Chromatograph, Gas Chromatograph-Mass Spectrometer, Liquid Chromatograph-Mass Spectrometer, Inductive Coupled Plasma-Mass Spectrometer and High Performance Liquid Chromatograph, as well as other facilities deemed necessary to accomplish its tasks. The laboratory equipment/facilities shall be regularly upgraded with modern technology to maximize the collection of data for its databases and libraries. The DDPLs shall develop analytical methods/techniques regarding contaminants/impurities by having reference standards of samples which will be used to establish the dangerous drugs profile database/library.

SECTION 9. The Members of the Management Committee and Chemists of the DDPLs shall be afforded the opportunities to undergo advanced special training, as well as be provided with updated articles/periodicals from forensic laboratories of foreign counterparts.

SECTION 10. For the purpose of establishing a dangerous drugs databank, it shall be the duty of the government laboratory to secure adequate samples to be used for drug profiling. The Chemistry Divisions of the Agencies concerned shall initiate the networking of the DDPLs from their existing equipment/facilities and available samples of seized dangerous drugs and correspondingly issue regulations necessary in accomplishing this purpose.

SECTION 11. The Board shall set aside a minimum amount of SEVEN MILLION PESOS (P7,000,000.00) annually to operate, manage and maintain the Dangerous Drugs Profiling Laboratory.

SECTION 12. Separability Clause — Should any provision/provisions of this regulation be declared unconstitutional or in contravention to RA 6425, as amended, the remaining provisions shall nevertheless remain enforceable.

SECTION 13. Repealing Clause — All regulations inconsistent herewith are hereby repealed or modified accordingly.

SECTION 14. Effectivity — This Regulation shall take effect upon its approval.
