BOARD RESOLUTION NO. R- 654, S. 1999, RESTORING THE SUBMISSION OF AN ENVIRONMENTAL COMPLIANCE CERTIFICATE (ECC) AS A PREREQUISITE IN THE ISSUANCE OF LOCATIONAL CLEARANCE/DEVELOPMENT PERMIT, REVOKING RESOLUTION NO. R-544, S. 1994



Quoted thereunder is the subject resolution, approved by the Board of Commissioners on 10 November 1999:

“WHEREAS, Resolution No. R-544, s. 1994, authorized HLURB management to treat the Environmental Compliance Certificate (ECC) as a condition in the issuance of a locational clearance / development permit rather than as a prerequisite in the issuance thereof due to difficulties and delay then encountered by the private sector in securing the same which in turn affected the Board’s performance in meeting its targets, resulting in an overall backlog in shelter production:

WHEREAS, findings disclose that violations of the conditions for the issuance of the development permit / locational clearance were committed by project proponents despite the restrictions imposed on the use thereof prior to tie issuance of the ECC;

WHEREAS, the Board is in the process of reexamining its policies, rules and procedures pertinent to issuance of permits and licenses, and finds that immediate restoration of the ECC as a prerequisite in the issuance of DP/LC would be more consistent with the current thrust on ensuring site suitability and public safety;

WHEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, to REVOKE Resolution No. R-544, s. 1994, as the same is hereby REVOKED, in effect hereby restoring the submission of an Environmental Compliance Certificate, duly issued by the Environmental Management Bureau or the Department of Environment and Natural Resources, as a prerequisite in the processing and issuance of the Development Permit/Locational Clearance.

APPROVED, 10 November 1999, Quezon City, Metro Manila.”

This circular takes effect immediately and shall apply to applications pending at the time of the effectivity hereof.
