[ LTFRB MEMORANDUM CIRCULAR NO. 98-011, March 12, 1998 ]

PUBLIC UTILITY JEEPNEY



In accordance with Item No. 2 of DOTC Dept. Order No. 97-1097, providing standard classification for all public land-based transport conveyances, applications for franchise to operate "Public Utility Jeepney" may propose the use of motor vehicles with the following features:

1. Seating Capacity- 12-32, excluding driver
2. Gross Vehicle Weight- 2,500 kgs. and above and/or 70 kg/pax
3. Body Make- Jitney type/AUV

The routes shall be fixed (regular, limited stop or express) or variable routes within a specified area as authorized. Ventilation may either be ordinary or air-conditioned, and the fare shall be based on distance or zonal as authorized by the LTFRB.

Operating conditions of Public Utility Jeepney are:

1. May be allowed to carry passenger or freight or both for provincial operations;

2. Operation is discouraged along major materials in urban areas; and,

3. Ceiling distance, unless authorized otherwise, shall be:
a.      15 kms. in urban routes; and

b.      30 kms. in inter-urban/provincial routes.
In the meantime and until further notice, in view of the present moratorium on the acceptance of new applications for franchises to operate public utility vehicles, only petitions not involving or resulting to additional units shall be accepted for consideration.

All issuances, or parts thereof, inconsistent herewith are hereby modified accordingly, superseded/revoked.

This Memorandum Circular shall take effect fifteen days (15) after the filing of three (3) copies hereof with the U.P. Law Center, pursuant to Presidential Memorandum Circular No. 11, dated October 9, 1992.
