[ LTFRB MEMORANDUM CIRCULAR NO. 98-012, March 12, 1998 ]

TAXI



In accordance with Item No. 5 of DOTC Dept. Order No. 97-1097, providing standard classification for all public land-based transport conveyances, applications for franchises to operate "Taxi" may propose the use of motor vehicles with the following features:

1. Vehicle Type-Four or five-door automobiles
2. Seating Capacity-4 excluding driver

The route is not fixed, but within a specified area. Ventilation may either be ordinary or air-conditioned, and the fare shall have a minimum rate plus fee per unit distance and unit time. No more than four (4) passengers may be carried. The color of the taxi shall be WHITE. However, colors other than white may still be allowed on the following conditions:

a. the authorized unit still has subsisting franchise

b. the authorized unit subject of petition for extension of validity of the CPC is still not due for phase out or replacement by newer models.

In cases of new application and/or substitution of units with no authority yet, the color of the proposed unit shall be white.

In the meantime and until further notice, in view of the present moratorium on the acceptance of new applications for franchises to operate public utility vehicles, as imposed under Memorandum Circular No. 97-009-A, only petitions not involving or resulting to additional units shall be accepted for consideration.

All issuances, or parts thereof, inconsistent herewith are hereby modified accordingly, superseded/revoked.

This Memorandum Circular shall take effect fifteen days (15) after the filing of three (3) copies hereof with the U.P. Law Center, pursuant to Presidential Memorandum Circular No. 11, dated October 9, 1992.
