[ POEA MEMORANDUM CIRCULAR NO. 13, February 13, 1992 ]

THE RESPONSIBILITY TO REPORT TO POEA SIGNIFICANT INCIDENTS CONCERNING OVERSEAS CONTRACT WORKERS



Pursuant to Rule I, Book VIII of the POEA Rules and Regulations on Assistance to Workers, and to ensure compliance therewith, the Administration deems its proper to reiterate the responsibility of the local agency to report to POEA significant incidents concerning overseas contract workers (OCWs), such as the following:

  1. Death 4. Runaway
  2. Injury or illness 5. Missing
  3. Detention 6. Desertion

Wherefore, all licensed placement and manning agencies, construction and service contractors are hereby directed to make the aforesaid report to POEA through the Director, Welfare and Employment Office (WEO) as soon as they become aware of said incidents

The report will enable POEA to coordinate with the local agency and with other entities as to the appropriate action or the assistance needed by the worker and his family.  It will also help update the records of the POEA on the particular worker.

Notwithstanding this Memorandum Circular, the report on runaway and desertion cases to the Director, Adjudication Office for purposes of watchlisting, if warranted by evidence submitted, shall however, continue.
