DESIGNATION OF THE BARGE POOL AT THE SOUTH HARBOR WEST BREAKWATER AS A LAY-UP AREA



1. AUTHORITY

1.1       Section 26 of PD 857. PPA's Revised Charter
1.2       PPA AO No. 07-89 "Designation of Lay-up Areas for PMOs"

2. SCOPE

This Order shall cover all barges/tugs/lighters which shall berth at the South Harbor Barge Pool Area

3. OBJECTIVES

3.1       To optimize the utilization of available berthing areas along the Pasig River;
3 2       To enhance sale and unobstructed navigation for vessels plying the Pasig River:
3.3       To rationalize the use of the mooring/anchoring facilities at the South Harbor Barge Pool:
3.4       To elicit the utmost cooperation of port users in contributing their efforts towards the attainment of the objectives of the Pasig River Rehabilitation Commission.

4. GUIDELINES

4.1       Designation of Lay-Up Areas - The Barge pool at the South Harbor West Breakwater is hereby designated as a Lay-Up Area. in addition to those already established under PPA AO No. 07-89.

Said area shall be indicated by the following coordinates:

"That are bounded by the West Breakwater until its southern tip thence along an imaginary line Range 040.5 degrees True through the Port Entrance Light and Customhouse Mast until the 120º 57' 30" E Longitude, thence along this longitude Northward until its intersection with the West Breakwater."

Anchoring/mooring outside the designated Barge Pool thus adversely affecting the adjacent berths fairways (passage below the southeastern limit of the Barge Pool) and the interchange area (immediately fronting the finger piers of South Harbor) is strictly prohibited.

4.2       Vessels Entitled to Avail of the Lay-Up Fee - For purposes of this Order the following shall be entitled to avail of the Lay-Up Fee:

4.2.1 Barges/Tugs/Lighters that stayed at the Barge Pool for more than fifteen (15) days, provided these are not under charter and not transporting cargoes;
4.2.2 Non-revenue generating watercrafts which have been idle for a considerable period and which have stayed at the Barge Pool for more than fifteen (15) days.

4.3       Procedures for Availing of the Lay-Up Area and the Corresponding Fee Thereof

4.3.1 The barge/tug/lighter shall file an Application for Berth at the Lay-Up Area with the Marine Operations Section (MOS) of PMO-South Harbor before entering said Lay-Up Area.
4.3.2 Upon approval by the Harbor Master or his representative the barge/tug/lighter shall proceed to the designated slot within the Lay-Up Area.
4.3.3 Prior to departure, an Exit Clearance shall be secured by a coastwise- licensed barge from the MOS of PMO-South Harbor. For a bay an river operating vessel, the MOS shall be notified of the vessel's intended movement.
4.3.4 The MOS shall determine the vessel's length of stay at the Lay-Up Area which shall be reckoned from the date of its arrival at the Barge Pool.
4.3.5 For a staytime of fifteen (15) days or less the barge/tug/lighter shall be subject to the applicable Usage Fee under PPA MC No. 07-94.
4.3.6 If the barge/tug/lighter stayed for more than fifteen (15) days, it shall be entitled to avail of the Lay-Up Fee, the rates of which are as prescribed under PPA MC No. 07-94.

4.4       Applicability of PPA Administrative Order No. 07-89

The provisions of PPA AO No. 07-89 which are consistent with this Order shall be observed by the laid-up vessel in addition to other regulations which may hereinafter be prescribed by the Authority.

5. REPEALING CLAUSE

All PPA orders. policies rules and regulations which are inconsistent herewith are hereby repealed or amended accordingly.

6. EFFECTIVITY CLAUSE

This Order shall take effect fifteen (15) days after publication in any newspaper of general circulation.
