IMPLEMENTING GUIDELINES ON THE EXTENSION OF THE IMMIGRATION STATUS GRANTED TO QUALIFIED DEPENDENTS OF INDIAN NATIONALS UNDER THE DEPARTMENT OF FOREIGN AFFAIRS NOTE VERBALE NO. 903730 DATED 17 SEPTEMBER 1990



In pursuance to the policy of the Department of Foreign Affairs (DFA) embodied in its letter to the Bureau of Immigration dated 25 June 1997 to renew the permanent resident status of qualified dependents of Indian nationals under the Department of Foreign Affairs Note Verbale No. 903730 dated 17 September 1990, we hereby promulgate the hereunder implementing guidelines:

Policy Statement

The Department of Foreign Affairs Note Verbale No. 903730 covers only the legitimate spouses and unmarried minor children of Indian nationals (hereinafter referred as the principal) who, prior to the suspension of the immigration reciprocity between the governments of the Republic of the Philippines and India, were granted quota immigrant visa.  The visa grant is for a period of three years renewable for another three years provided the recipients have not yet reached the age of majority or eighteen (18) years of age or they have not yet been emancipated by marriage.

Procedure

I. Petitions for the renewal of the permanent resident visa under the Note Verbale shall be made and filed by the principal in behalf of his legitimate spouse and unmarried minor children alleging among others the following:

A. Personal Data on the Principal:

1.    Name and address;
2.    Passport number, date and place of issue, and validity;
3.    Number of his quota immigrant visa;
4.    Date and grant of visa;
5.    Name of the Commissioner who issued the visa;
6.    Alien Certificate of Registration, its place and date of issue
7.    Immigrant Certificate of Residence, its place and date of issue

B. Personal Data on the Legitimate Spouse:

1.    Name and address;
2.    Passport number, date and place of issue and validity;
3.    Visa, validity;
4.    Alien Certificate of Registration Number, date, and place of issue;
5.    Certificate of Residence Temporary Visa number, date and place of issue;
6.    Date and place of marriage

C. Personal Data on the Unmarried Minor Children:

1.    Name and address;
2.    Passport number, date and place of issue and validity;
3.    Visa, validity;
4.    Alien Certificate of Registration Number, date and place of issue
5.    Certificate of Residence Temporary Visa Number, date and place of issue;
6.    Date and place of birth;
7.    Name of parents

D. Minor Children are still not married and should it be found out that perjury has been committed, the visa, both of the principal and the dependents shall be revoked and they will be subjected to summary deportation.

II. Documents to be submitted in support of the petition:

1.    Passports of the principal (old and new), of the legitimate spouse and the unmarried minor children
2.    ACR’s
3.    CRTV’s
4.    ICR
5.    Marriage Certificate/Contract of the principal and his spouse
6.    Birth Certificate of children
7.    Affidavit of Support
8.    Proofs of support
9.    Aids Clearance of spouse and children
10.  Affidavit by the principal that minor children are still unmarried
11.  NBI Clearance of applicants

III. Petitions shall be filed at the Office of the Commissioner after payment of the Express Service fee for each applicant.

IV. Extension fee of P 200/month shall be assessed against each applicant after approval but prior to the implementation of the visa.

V. The visa shall entitle holders thereof to the issuance of a Special Return Certificate.

This Order shall take effect immediately.
