[ LTFRB MEMORANDUM CIRCULAR NO. 97-001, December 16, 1996 ]
REVOCATION OF ALL MEMORANDUM CIRCULARS ALLOWING "FLEXIBILITY IN BUS OPERATIONS" IN ACCORDANCE WITH AND PURSUANT TO DOTC DEPARTMENT ORDER NO. 96-967 DATED 28 AUGUST 1996
In accordance with and pursuant to DOTC Department Order No. 96-967, the “Flexibility in Bus Operations” the LTFRB allowed bus operators in 1991 for them to effectively respond to commuter demand and public convenience, is set aside.
LTFRB Memorandum Circular Nos. 91-007, 91-007-A. 93-004, 93-010, 96-001, and all issuances relative to flexibility in bus operations are therefore, set aside and revoked.
The Flexibility in Bus Operations” was allowed by the LTFRB to give leeway and flexibility to bus operators in responding to commuter demand and to effectively address public necessity in their franchised routes.
However, this privilege given to bus operators of shifting a reasonable number of their authorized units from one franchised route to another franchised route without sacrificing public convenience in their routes from where the shifted units are withdrawn to meet the exigencies of public demand, has been greatly abused.
Franchised routes have been abandoned with the units therein authorized shifted and diverted on a permanent basis to other more lucrative franchised routes, to the prejudice of commuters on the routes neglected or abandoned.
Destructive and cutthroat competition has also been created on routes where a greater number of units have been diverted and dumped under the “Flexibility in Bus Operations”.
With the revocation of this privilege pursuant to and in accordance with DOTC Department Order No. 96-967, bus operators are enjoined to comply with the terms and conditions in their Certificates of Public Convenience.
In accordance with Presidential Memorandum Circular No. 11, dated October 9, 1972, three (3) copies hereof shall be filed with the U.P. Law Center, on or before fifteen (15) days prior to the effectivity of this Memorandum Circular.
