[ LTO ADMINISTRATIVE ORDER NO. 97-001, September 21, 1996 ]

RULES AND REGULATIONS GOVERNING THE REGISTRATION OF UNDOCUMENTED MOTOR VEHICLES



Pursuant to the provisions of Section 4 (d-1) of Republic Act 4136, as amended, otherwise known as the Land Transportation and Traffic Code, the following rules and regulations governing the registration of undocumented motor vehicles and component parts are hereby promulgated for the guidance and observance of all concerned.

SECTION 1.       Coverage. — This Order shall cover the registration of undocumented motor vehicles and component parts such as engine, chassis and body, acquired prior to the effectivity of this Order such as:

1.         Trucks and utility vehicles of World War II vintage such as Original Army jeeps, weapons carrier, six by six (6 x 6) trucks, and personnel carriers;

2.         Motor vehicle component parts such as engine, chassis and body which are previously registered prior to the effectivity of this Order as evidenced by photocopies of either the official receipt or Certificate of Registration duly confirmed or verified by the Sectoral Office Property Section, but records of which are already missing due to force majeure and could no longer be found nor reconstituted through any possible means;

3.         Motor vehicle component parts with source documents issued prior to July 8, 1988, provided it is accompanied by a copy of the Stock Report duly stamped received by the LTO Registration Section before July 8, 1988.

SECTION 2.       Procedure. — The following procedure shall be strictly followed:

1.         The applicant shall apply for registration in the District Office to be designated by the Regional Director of the Region having jurisdiction over the motor vehicle;

2.         The applicant shall fill up an application form prescribed for the purpose and pay the corresponding fee of ONE HUNDRED PESOS (P100.00);

3.         The designated District Office shall conduct an actual inspection of the motor vehicle and shall submit its initial findings and recommendations to the Regional Director for final disposition, using the format prescribed herein;

4.         Upon approval, the applicant shall cause the publication of the approved application in any newspaper of general circulation once a week for three (3) consecutive weeks to serve as a notice to all persons who may have claims or interest over the motor vehicle or component part. If no adverse claim is filed after thirty (30) days from date of last publication, all adverse claims shall be barred and the motor vehicle shall be accepted for registration.

SECTION 3.       Documentation. — The following documents shall be required for the initial registration of these motor vehicles and component parts:

1.         Duly approved application together with the official receipt evidencing payment of the application fee;

2.         Affidavit of ownership and undertaking executed by the owner stating among others, the reason/s for the non-registration of the motor vehicles and/or component, the facts surrounding the loss of the documents, and absolving the Land Transportation Office from any liability, civil or otherwise, arising from its registration;

3.         Duly accomplished and approved Motor Vehicle Inspection Report (MVIR);

4.         Affidavit of Publication executed by the publisher together with a copy of the published article;

5.         PNP/TMC Clearance;

6.         Surety Bond equivalent to the prevailing market value of the motor vehicle or component for one (1) year; and

7.         Appropriate Insurance Certificate of Cover.

SECTION 4.       Fees. — the fees to be collected during its initial registration shall be one year plus fifty per cent penalty placed under automatic storage and thereafter collect the applicable portion of the year depending on the last digit of the plate number to be issued and other miscellaneous fees.

SECTION 5.       Control Mechanism. — For purposes of uniformity and control, the following safeguards shall be adopted:

1.  All pages of the Certificate of Registration and Motor Vehicle Registration Receipt (MVRR) shall be stamped "NO RESALE OR TRANSFER WITHIN ONE (1) YEAR FROM DATE OF INITIAL REGISTRATION".

SECTION 6.       Amendatory Clause. — All orders, memoranda, rules and regulations in conflict herewith are hereby deemed amended, superseded or modified accordingly.
