[ LTFRB MEMORANDUM CIRCULAR NO. 2000-013, May 29, 2000 ]

PROCEDURE AND POLICY FOR THE FRANCHISING OF BUSES ON IDENTIFIED PROVINCIAL ROUTES ENTERING METRO MANILA POSTED ON JUNE 1, 2000



As earlier announced under Memorandum Circular No. 2000-012 issued on May 10, 2000 the list of provincial routes/lines entering Metro Manila open for application will be posted in conspicuous places in the premises of the Board on June 1, 2000.

After one (1) month from the posting of the said list of lines/routes, the Board will stop the acceptance of applications on these lines. Thereafter, the applications will be set for hearing.

In processing and resolving the applications, the Board will be guided by the following procedure and policy:

1.         All pending applications filed prior to June 1, 2000 will be included among the applications filed on or after June 1 for hearing and resolution;

2.         Applications on the same or identical lines/routes will be heard jointly through a summary proceeding, with a joint decision issued for all applications on the same or identical routes;

3.         Pursuant to and in accordance with the mandate prescribe under the Public Service Act and to insure that public welfare and interest are safeguarded, the Board will place great weight on the financial and technical qualifications of the applicants, demonstrated in their: (a) latest audited financial statements and income tax returns; (b) asset bases; (c) capability to put up brand new buses; (d) ownership/possession of terminals, garages and adequate support facilities such as repair and maintenance shops equipped with standard equipment and tools; and (e) track records if the applicants are existing franchised bus operators.

The Board considers the opening of the lines/routes for PUB application as an opportunity to start the modernization of the country’s bus fleets starting with the lines/routes that will be applied for.

Hence, only the most financially qualified applicants with the technical capability and facilities to provide the most efficient, safe, adequate and comfortable transport services will be allowed to provide the needed buses on the lines/routes opened for application.

This Memorandum Circular takes effect immediately.
