[ DDB BOARD REGULATION NO. 3, February 15, 1990 ]

SUBMISSION OF SPECIMENS AND/OR PARAPHERNALIA CONFISCATED BY LAW ENFORCERS FOR LABORATORY EXAMINATION TEST



Pursuant to the powers vested in it by Section 36(a) of RA. 6425, as amended, the Dangerous Drugs Board hereby prescribes the following regulation:

SECTION 1.       —

A.      In Metro Manila — Specimens and/or paraphernalia confiscated from violators of any of the provisions of R.A. 6425, as amended, shall, within twenty-four (24) hours from the time of the arrest or seizure be submitted by the arresting/apprehending officer either to the Philippine Constabulary Criminalistic Laboratory, National Bureau of Investigation or DDB Laboratory for laboratory examination/test.

B.      In Places Outside Metro Manila — If the arrest or seizure is made in places outside Metro Manila, said specimens and/or paraphernalia shall be submitted within a reasonable period to the nearest laboratory of the NBI or PCCL for the necessary laboratory examination/test.

SECTION 2.       Violation hereof shall be dealt with administratively or criminally, as warranted in the premises.

SECTION 3.       This regulation shall take effect after its publication in a newspaper of general circulation once a week for two (2) consecutive weeks.
