[ LTO DEPARTMENT ORDER NO. 98-1195, December 07, 1998 ]

REQUIRING AND DIRECTING THE IMPLEMENTATION OF THE DRIVER'S LICENSE ENHANCEMENT PROGRAM FOR ALL PROFESSIONAL AND NON-PROFESSIONAL DRIVER'S LICENSE HOLDERS



WHEREAS, the LAND TRANSPORTATION OFFICE (LTO), by virtue of Section 2 of ADMINISTRATIVE ORDER NO. 222 dated 30 May 1991 mandated the NATIONAL ROAD SAFETY COMMITTEE (NRSC) under letter "d", to recommend legislative measures to amend, supplement and/or enact laws on road safety travel" and under letter "e", "to request assistance of any government agency, department, bureau or office, including government owned and/or controlled corporations as may be necessary in the accomplishment of its operational activities";

WHEREAS, the LAND TRANSPORTATION OFFICE (LTO), by virtue of Section 4 of ADMINISTRATIVE ORDER NO. 222 dated 30 May 1991 and amended by ADMINISTRATIVE ORDER NO. 329 mandated the NATIONAL ROAD SAFETY COMMITTEE to "establish an effective monitoring system to ensure the timely and responsive implementation of the policies and programs on road safety. Based on this, the Committee shall submit a regular report to the President and the Cabinet on the status of the implementation of these policies and programs, including its recommendations, if any, to further enhance road safety in the country";

WHEREAS, numerous motorists still lose their lives and limbs due to vehicle-related accidents, many of whom are poor Drivers who can not afford the high cost of medical treatment, or worst, those whose relatives can not afford the final expenses of a decent burial.

NOW, THEREFORE, I, BENJAMIN G. CALIMA, Assistant Secretary, Land Transportation Office, Department of Transportation and Communications, in the interest of the Drivers, who often become poor victims of vehicular accidents while in the performance of their duties as drivers of motor vehicles or even as passengers of the same, do hereby order:
  1. That all bonafide Driver's License holders are required to enroll in the Driver's License Enhancement Program to extend the much needed financial assistance to Drivers who become victims of vehicular accidents while actually driving motor vehicles or as passengers hereon.

  2. All drivers applying for licenses, whether new or for renewal, shall be required to secure from the Government Service Insurance System (GSIS) desk located within the License Issuing Agency, the enhancement program requirement before the LTO issues/ore renews the driver's licenses.

  3. The cost of this Driver's License Enhancement Program is Thirty Pesos (P30.00) per year or Ninety Pesos (P90.00) for the three (3) year term of the driver's license with the following benefits:
    * P30,000.00 for ACCIDENTAL DEATH

    * P30,000.00 for DISMEMBERMENT based on standard schedule

    * P30,000.00 for PERMANENT DISABLEMENT DUE TO ACCIDENT

    * P5,000.00 for MEDICAL REIMBURSEMENT DUE TO ACCIDENT
    ** Note: Coverage is extended not only to Drivers who are driving motor vehicle but also to Drivers who are passengers in vehicle-related accidents.

  4. The LAND TRANSPORTATION OFFICE shall be the lead Agency in the implementation of this Program, with the full support of the GOVERNMENT SERVICE INSURANCE SYSTEM, which will underwrite all claims arising from this Program.

  5. This Order shall take effect upon approval.
