CONFIRMATION OF UNITS



The Board has received reports that some operators, in defiance with the rules of the Board, would intentionally omit having their units confirmed by the LTFRB before registering the same with the Land Transportation Office.  This creates havoc and chaos, and renders nugatory the transport plans and programs of the LTFRB and the DOTC as some units registered are not actually authorized under the franchise of the operators concerned.  Such situation breeds an environment where “colorum” vehicles can thrive and multiply without control.

Accordingly, all public utility vehicle operators are hereby enjoined to have their units confirmed first by the LTFRB before registering the same with the Land Transportation Office. After proper notice and hearing, and if evidence warrants, any operator found to have violated this rule shall suffer the appropriate penalty provided for by law.

All other issuances or parts thereof which are inconsistent herewith, are therefore modified or superseded accordingly to conform with this new directive.

This Circular shall take effect fifteen (15) days after the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
