[ BOC CUSTOMS MEMORANDUM ORDER NO. 9-97-A, May 22, 1997 ]

AMENDMENT TO CMO 9-97 DATED APRIL 4, 1997 ON THE TREATMENT OF PERISHABLE GOODS PURSUANT TO SECTION 2607 OF THE TARIFF AND CUSTOMS CODE, AS AMENDED




A.        AMENDED DIVISIONS

To better attain its objectives, certain provisions of CMO 9-97 are hereby amended, to wit :

1.  A portion of Annex "A" mentioned in Paragraph IV, 1.1 shall read as follows:

"CERTIFICATION

Date____________

Time____________

This is to certify that the aforementioned goods is/are liable to perish or be wasted and should be disposed pursuant to Section 2607 of the TCCP in the same manner that the articles listed in Annexes "B", "C" and "C-1" and "D" to "D-4" were previously disposed.

2.  Pertinent Operational Provisions under Paragraph IV shall read as follows:

"2.     Assessment Division of the Port Concerned

2.1          x x x

2.2          The certification shall be based on the criteria mentioned in Paragraph III-A or on previous certifications issued and sale(s) of goods as perishable like as listed in Annex "B", "C" and "C-1" and "D" to "D-4" which form as integral parts of this Order."

3.         The list of perishable goods mentioned in Paragraph IV, 2.2 and marked as Annex "B" shall read as follows:
