[ CESB RESOLUTION NO. 667, March 13, 2007 ]

AMENDMENT ON THE COVERAGE OF THE RULES ON REASSIGNMENT AND TRANSFER IN THE CES AS PROVIDED UNDER CESB RESOLUTION NO. 640, S. 2006



WHEREAS, on July 11, 2006, the Board adopted CESB Resolution No. 640 s. 2006 (Rules on Reassignment and Transfer of CESOs who are Presidential Appointees Occupying CES Positions) purposely to lay down the coverage, guidelines and procedures in the reassignment and transfer of CESOs who are presidential appointees occupying CES positions;

WHEREAS, item No. 2 (Coverage) of the above-cited policy expressly indicates that the same applies only to CESOs, who are appointed by the President to CES positions in various departments and agencies of the national government covered by the CES including those in government owned or controlled corporations with original charters;

WHEREAS, various queries have been received by the Board on the said policy guidelines particularly on the issue of whether Career Executive Service (CES) eligibles and Career Service Executive (CSE) eligibles, who are presidential appointees occupying CES positions, are covered by CESB Resolution No. 640 s. 2006;

WHEREAS, CESB Resolution No. 640 s. 2006 does not explicitly provide whether the said Career Executive Service (CES) eligibles and Career Service Executive (CSE) eligibles are covered and if not, whether the rules adopted by the Civil Service Commission (CSC) on reassignment and transfer are applicable to them;

WHEREAS, the Civil Service Commission (CSC) and the Career Executive Service Board (CESB) jointly adopted Resolution No. 05-001 dated July 29, 2005 providing for the rules and regulations in the implementation of unified third level examination system;

WHEREAS, excluding CESEs/CSEEs, who are presidential appointees occupying CES positions, from the coverage of CESB Resolution No. 640 s. 2006, although they are similarly situated with the CESOs, create not only confusion and problem in the implementation of the policy in the CES but also establishes inequality and inconsistency in the application of the said rules;

NOW, THEREFORE, foregoing premises considered, the Board, RESOLVES, as it is hereby RESOLVED, to amend the coverage of CESB Resolution No. 640, s. 2006 (Rules on Reassignment and Transfer of CESOs who are Presidential Appointees Occupying CES Positions) to include Career Executive Service (CES) eligibles and Career Service Executive (CSE) eligibles, who are presidential appointees occupying Career Executive Service positions.

CES eligibles refer to those who took and passed the four-stage CES eligibility examination process administered by the Career Executive Service Board. On the other hand, CSE eligibles refer to those who took and passed the two-phased Career Service Executive Examination (CSEE) administered by the Civil Service Commission (CSC).

RESOLVED, FURTHER, that the Civil Service Commission and the Office of the President will be provided copies of this policy resolution.
