[ MMDA REGULATION NO. 99-003, February 25, 1999 ]

FURTHER AMENDING MMDA REGULATION NO. 98-002 RE: MMDA FINANCIAL ASSISTANCE TO GOVERNMENT TRAFFIC ENFORCEMENT UNITS IN METRO MANILA



WHEREAS, MMA Ordinance No. 1, s. 1994 provides for the grant of 20% to traffic enforcement units out of the 25% total traffic fines collected in Metro Manila and MMA Ordinance No. 5, s. 1995 provides for a grant of 25% financial assistance to LGUs out of fines collected for violations committed in their respective localities as funds for the LGUs for the maintenance and operation of traffic management in their respective jurisdictions;

WHEREAS, MMDA Regulation No. 98-002 has amended Sec. 1 of MMDA Ordinance No. 1, s. 1994 and Sec. 4 of MMA Ordinance No. 5, s. 1995 by providing for 10% financial assistance to traffic enforcers, 5% to traffic, enforcement units, and 10% financial assistance to LGUs;

WHEREAS, Section 1(b) of MMDA Reg. No. 98-002 provides that out of the 15% of the total fines collected intended as financial assistance to traffic enforcers and traffic enforcement units concerned, five (5%) percent shall be released to traffic enforcement units as funds for office maintenance and operating expenses in accordance with COA Rules and Regulations;

WHEREAS, COA's Rules and Regulations require the recipient of the 5% incentive to submit liquidation documents and other supporting papers;

WHEREAS, to ensure the funds are being utilized for the intended purpose, there is a need to amend MMDA Regulation No. 98-002;

NOW, THEREFORE, Pursuant to Section 6 of RA 7924, this Regulation is hereby promulgated and adopted that:
"SECTION 1. Manner of Disbursement and Distribution — the 15% of the total fines collected intended as financial assistance to Traffic Enforcers and Traffic Enforcement Units concerned shall be distributed as follows:

b. Five (5%) percent shall be released to Traffic Enforcement Units as funds for office maintenance and operating expenses in accordance with COA Rules and Regulations. The Traffic Enforcement Unit concerned or the Head/Authorized Payee thereof shall render an accounting and submit supporting documents on how the 5% MOE fund was expended."
This Regulation shall take effect upon approval.
