AMENDING MEMORANDUM CIRCULAR NO. 94-004 (SMOKE BELCHING PUVS AND SANCTIONS THEREON)



On February 24, 1994, this Board issued Memorandum Circular No. 94-004, the subject of which is the life-threatening effect of air pollution caused by motor vehicles emitting smoke daily plying different routes in Metro Manila with the corresponding penalties for violations committed relative thereto.

Considering that air pollution poses a clear danger to the health of residents of the metropolis, causing respiratory ailments and sometimes results in deaths, the Board hereby amends the sanctions imposed therein as follows:

1.         First Violation

Suspension of Unit Involved Until Operator Has Submitted A Certification From the LTO or Concerned Agency That Said Unit Passed the Smoke Belching Test;

2.         Second Violation

One (1) month Suspension For The Unit Subject Of the First Violation With or Without The Certification and/or Clearance; and

3.         Third  Violation

Cancellation of the Same Unit Subject of the First and Second Violation From the CPC of the Operator.

All issuances, or parts thereof, inconsistent herewith are hereby deemed modified, superseded/revoked accordingly.

This amendatory circular shall take effect fifteen (15) days after the filing of three (3) copies hereof with the U.P. Law Center, pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
