[ MMDA RESOLUTION NO. 23, September 26, 1996 ]

DISPOSITION OF FINES COLLECTED IN VIOLATION OF ADMINISTRATIVE AND TRAFFIC RULES AND REGULATIONS BY MOTORIZED TRICYCLE AND PEDICABS



WHEREAS, the power to regulate the operation and the grant of franchises to tricycles and pedicabs were devolved to the Local Government Units;

WHEREAS, Paragraph b, Sec. 3 of RA 7924 defines the Scope of Metropolitan Manila Development Authority (MMDA) Services which includes among others, transport and traffic management . . . administration and implementation of all traffic enforcement operations, traffic engineering services and traffic education programs including the institution of a single ticketing system in Metropolitan Manila;

WHEREAS, among the functions and powers of the MMDA is to install and administer a single ticketing system, fix, impose and collect fines and penalties for all kinds of violations of traffic rules and regulations, whether moving or non-moving in nature, and confiscate and suspend or revoke drivers licenses in the enforcement of such traffic laws and regulations, the provisions of RA 4136, and PD 1605 to the contrary notwithstanding;

WHEREAS, the Metro Manila Council (Council) believes that a workable agreement should be fashioned out to give meaning and effectivity to both provisions of law by the Local Government Units to use MMDA Traffic Violation Receipt (TVR) in apprehending motorized tricycles and pedicabs drivers/operators that violate administrative and traffic rules and regulations.

NOW, THEREFORE, pursuant to Section 6 of RA 7924, be its resolved that the Council hereby resolved that the fines collected in violation of administrative and traffic rules and regulations by motorized tricycle and pedicabs shall accrue in favor of the following:

1.         Twenty (20%) percent financial assistance disburse to traffic enforcement units distributed as follows:

a.      80% to traffic enforcers concerned as incentives;

b.      20% to be retained by traffic enforcement unit as funds for maintenance.

2.         Thirty (30%) percent to the MMDA as financial assistance in support to the MMDA Traffic Management function.

3.         Fifty (50%) percent to the Local Government Units where the violation was committed.

This Resolution shall take effect upon approval.
