REQUIRING CARGO TRUCKS AND HEAVY VEHICLES TO UTILIZE SERVICE ROADS INSTEAD OF USING FLYOVERS, INTERCHANGES AND TUNNELS IN METRO MANILA



WHEREAS, cargo trucks and heavy vehicles with a gross capacity weight of more than 4,500 kilograms, when loaded, pose danger to other vehicles especially when they suffer mechanical defect at the ingress/egress of and/or within flyovers, interchanges and tunnels;

WHEREAS, cargo trucks and heavy vehicles occupy a wide portion of the carriageway and are big enough to block or stop traffic flow when it gets stalled, requiring hours before they could be removed from the roadway, which in many instances, results to massive traffic jam;

WHEREAS, it is necessary to adopt measures that would prevent congestion and. keep the streets of Metro Manila safe for all motorists;

WHEREAS, many of the flyovers, interchanges and tunnels constructed in Metro Manila are provided at-grade or ground level service roads mainly utilized by public utility vehicles and those taking a turn at the intersection.

NOW THEREFORE, pursuant to Section 6 of RA 7924, this Regulation is hereby promulgated and adopted by the Metro Manila Council, that:

SECTION 1.       Coverage . — Cargo trucks and heavy vehicles having a gross capacity weight of more than 4,500 kilograms are hereby prohibited from utilizing flyovers, interchanges and tunnels in Metro Manila, provided that at-grade or ground level service roads are available to provide passage to cargo trucks and heavy vehicles affected by this Regulation, provided further that, where there are no service roads or the same cannot be utilized, affected vehicles are allowed access to said flyovers, interchanges and tunnels in Metro Manila.

SECTION 2.       Penalty . — Drivers of cargo trucks violating this Regulation shall be penalized with a fine of FIVE HUNDRED PESOS (P500.00).

SECTION 3.       Effectivity. — This Regulation shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation.
