[ DDB BOARD REGULATION NO. 2-A, s. 1984, May 23, 1984 ]

PRESCRIBING THE MAXIMUM AND MINIMUM AMOUNT OF REWARD TO AN INFORMER AND OTHER RELATED MATTERS



Pursuant to Section 36(o) of Republic Act No. 6425, otherwise known as the Dangerous Drugs Act of 1972, as amended, the following are hereby prescribed:

SECTION 1.       The basic amount of reward shall be computed at 5% of the market value of dangerous drug as stipulated in the succeeding Section.

SECTION 2.       The market values of dangerous drugs shall be as follows:

a.       Opium — P16.00 per gm of 10% anhydrous morphine

b.       Morphine — P13.00 per gm of 10% anhydrous morphine

c.       Heroin — P23.00 per gm of 10% purity

d.       Prohibited Plants excluding Marijuana — P50.00 per plant

e.       Prohibited Plant Seeds — P3.00 per gm

f.        Cocaine — P200.00 per gm of 95% purity

g.       LSD and other Hallucinogens — P320.00 per gm of 75% purity

h.       Herbal Cannabis (Marijuana Leaves) — P1.50 per gm (Fresh — weight times 42.4 to reduce to dried weight)

i.        Herbal Cannabis (Flowering Tops)/Thai Sticks — P3.00 per gm

j.        Cannabis Resin (Hashish) — P15.00 per gm

k.       Cannabis Resin Oil (Hashish Oil) — P45.00 per gm of 40% THC

l.        Amphetamine — P210.00 per gm of 95% purity

m.     Licit Pharmaceutical Dangerous Drug Preparations — current licit market price

SECTION 3.       In any case, the maximum amount of reward to an informer who is primarily instrumental in the discovery and seizure of a dangerous drug, except Marijuana plants, in the apprehension of violators of the aforecited Act shall be as follows:

Any Opiate Drug, or
other Prohibited
Drug, except Marijuana —                  P100,000.00

Any Marijuana or Regulated Drug —        P50,000.00

When a case involves seizure of more than one type of drug, the total maximum amount of reward should not exceed P200,000.00 for Prohibited Drugs, except Marijuana, P100,000.00 for Marijuana and Regulated Drugs, but in no case should the total maximum reward for seizures of Prohibited and Regulated Drugs exceed P300,000.00

SECTION 4.       A reward of P50,000.00 shall be given to an informer whose information is primarily instrumental in the discovery and seizure of a clandestine dangerous drugs laboratory (Reference: Clandestine Drug Laboratories:  Chemicals & Equipment — INTERPOL) and in the apprehension of the operators of said laboratory for violation of Sections 7 or 14-A of RA 6425, as amended.  Additional reward shall be given for the dangerous drugs seized as stipulated in Section 3 of this Regulation, but in no case should the total maximum reward for the clandestine dangerous drugs laboratory and the seized dangerous drugs exceed P350,000.00

SECTION 5.       In any case, the minimum amount of reward for information primarily instrumental in the discovery and seizure of dangerous drugs, except Marijuana plants, in the apprehension of violators of the aforecited Act shall not be: (a) less than 2-1/2% of minimum fine under Sections 3, 4, 5, 9 (excluding marijuana), 14, 15, 21 (excluding manufacture of dangerous drugs and cultivation of marijuana plants), and 27 of RA 6425, as amended, corresponding to any violation committed, or P500.00 whichever is higher; (b) less than three percentum (3%) of the minimum fine under Sections 5, 8, 11 and 16 of RA 6425, as amended, corresponding to any violations committed, or P300.00 whichever is higher; and (c) less than P200.00 for any violation of Sections 6, 10, 12, 13,17, 18 and 19 of RA 6425, as amended.

SECTION 6.       This Regulation rescinds BR No. 3, s. 1972, BR No. 12, s. 1973, BR No. 19, s. 1973, BR No. 1, s. 1974, BR No. 1, s. 1976, BR No. 2, s. 1976, BR No. 4, s. 1977, BR No. 1, s. 1981 and BR No. 5, s. 1983.

SECTION 7.       In view of the fluctuating market values of dangerous drugs, there is hereby created a Committee to review the above prices from time to time and recommend to the Board such revisions thereof as it may deem necessary.  The Committee shall be composed of one representative each from the Dangerous Drugs Board, the Narcotics Command, the National Bureau of Investigation, the Finance Ministry Intelligence Bureau, and the Bureau of Customs to be designated by their respective agency heads.  The Chairman of the Committee shall be chosen by a majority vote from among the members sitting en ban.

SECTION 8.       This Regulation shall take effect after fifteen (15) days following the completion of its publication in the Official Gazette.
