[ DTI ADMINISTRATIVE ORDER NO. 3, February 07, 1991 ]

Amending Provisions Of Commerce Requiring Price Tags or Labels To Be Affixed On All Articles Of Commerce For Sale Or Retail



Pursuant to Title X, Book IV of the Administrative Code of 1987 and to effectively implement the provisions of Republic Act No. 71 otherwise known as the Price Tag Law, the following Rules and Regulations amending Commerce Administrative Order No. 2, series of 1946 as amended are hereby promulgated:

1.  There shall be posted in conspicuous places in the establishment deals with the following articles of commerce and trade:

a. Minute or tiny articles such as but not limited to:

1. drugs, medicines, medicinal instruments;

2. hardware, plumbing/fixtures and electrical supplies;

3. toilet articles; and

4. jewelries

b. Perishable products, such as but not limited to:

1. vegetables;

2.  meat; and

3. poultry products

2. In exceptional cases where prices tags were inadvertently omitted on items offered for sale at retail, the same may not be considered a violation of the Price Tag Law, provided the number of untageed items do not exceed five (5) percent of the total number of the same product(s) and brand(s) and size(s), sold, displayed or offered for sale at the time of monitoring or validation by the DTI.

No inadvertent omissions in the price lists or price posters shall be countenanced.

3. In exceptional cases where two or more prices are inadvertently printed or attached to the identical product, the lower price shall prevail.

Should the customer pay the higher price despite the above rule, he shall be entitled, upon demand, to reimbursement within 24 hours from date of purchase.

4. No erasures, alterations shall be allowed except in the following:

a. In cases of sales promotion, only for the purpose of showing the difference between the regular and the sale of discounted price.

b. In cases of superimposition of prices provided only one price is visible to prevent confusion on the part of the buyer.

5. All previous rules and regulations which are inconsistent with this Order are hereby revoked.

6. These rules and regulations shall take effect immediately upon publication in a newspaper of general circulation.
