COMPENSATION OF THE MEMBERS OF THE PROVINCIAL/CITY MINING REGULATORY BOARD



1.         Purpose

This Circular is issued to prescribe rules and regulations on the payment of compensation to the members of the Provincial/City Mining Regulatory Board as provided under Section 25 of DENR Administrative Order No. 84, s. 1992 on the Rules and Regulations to Implement Republic Act No. 7076 otherwise known as the People's Small Scale Mining Act of 1992.

2.         Coverage

All members of the Provincial/City Mining Regulatory Board, hereinafter referred to as the Board, which was created pursuant to Section 24 of Republic Act No. 7076.

3.         Rules and Regulations

3.1    All members of the Board may be entitled to per diem not exceeding P1,000 per session attended but not to exceed four (4) paid sessions or P4,000 per month.

3.2    The support staff of the Board may be granted honoraria not exceeding P200 per session attended but not to exceed four (4) paid sessions or P800 per month.

3.3    The members and support staff of the Board may collect per diems/honoraria from more than one source, provided however, that the aggregate compensation received shall not exceed their monthly basic salaries.

3.4    Payment of honoraria authorized herein shall be subject to the 45%/55% limitation on personal services.

4.         Funding Source

Funds necessary for the implementation hereof shall be sourced from the taxes, fees and charges collected from mining contractors, consistent with Sections 26 and 27, Chapter VI of the above-cited DENR Administrative Order.

5.         Effectivity

This Circular takes effect immediately.
