AMENDING BOARD REGULATION NO. 3, S. 1996 BY INCLUDING LOCAL MANUFACTURERS IN ITS CONTROL MECHANISMS AND PRE-NOTIFICATION, CERTIFICATION OF IMPORTS AND EXPORTS

Pursuant to the powers vested in the Dangerous Drugs Board under Section 36(a), R.A. 6425, as amended and following the provisions of and in accordance with Article 12 of the 1988 United Nations Convention Against Illicit Trafficking on Narcotic Drugs and Psychotropic Substances, which was ratified by the Philippine Senate on February 26, 1996, the following control measures on the precursors and essential chemicals included in Tables I and II as an Annex to the said Convention and hereunder enumerated, are hereby prescribed:

SECTION 1.       Substances included in Table I:

Ephedrine
Ergotamine
Isosafrole
Lysergic acid
3.4-methylenedioxyphenyl-2-propanone
1-phenyl-2-propanone
Piperonal
Pseudoephedrine
Safrole

</BLOCKQUOTE>
The salts of the above substances whenever the existence of such salts is possible.

SECTION 2.       Substance included in Table II:

Acetic anhydride
Acetone
Anthranilic acid
Ethyl ether
Hydrochloric acid *
Methyl ethyl ketone
Phenyl acetic acid
Piperidine
Potassium permanganate
Sulphuric acid *
Toluene

The salts of the above substances whenever the existence of such salts is possible.

SECTION 3.       Control measures:

3.1.      For importers, distributors, and/or wholesalers and LOCAL MANUFACTURERS

3.1.1.       Registration with the Control, Regulation and Intelligence Division of the Board;

3.1.2.       Payment of fees:

a.         For S-5-I License        P360.00
b.         For S-4 License          180.00
</BLOCKQUOTE>

3.1.3.       PRE-NOTIFICATION CERTIFICATES OF IMPORTS AND EXPORTS;
</BLOCKQUOTE>

3.1.4.       Accomplishment of Special Permit: (DDB Form No. 9-72) to be submitted to the Board before importation;

3.1.5.       Submission to the Board of forecast estimate of item(s) to be imported or LOCALLY MANUFACTURED during the following year;

3.1.6.       Submission of quarterly report relative to distribution, disposition or usage of item(s) imported, INCLUDING THOSE LOCALLY MANUFACTURED;

3.1.7.       Submission to the Board of an itemized report of all controlled items imported and LOCALLY MANUFACTURED stating therein the following data:

a.         date of importation/MANUFACTURE
b.         quantity imported/MANUFACTURED
c.         those IMPORTATIONS already received
d.         those IMPORTATION not yet received

<BLOCKQUOTE>
3.1.8.       Inspection of premises by DDB Drug Officers and by deputized agents of the Board; and

3.1.9.       In case the imported item shall be re-exported OR THE LOCALLY MANUFACTURED ITEM SHALL BE EXPORTED, clearance must be secured from the Board.

SECTION 4.       Repeal of Inconsistent Board Regulations.

All Board Regulations inconsistent herewith shall be deemed modified or amended.

SECTION 5.       Sanctions

Violation of this Regulation shall be penalized with administrative sanctions, without prejudice to criminal sanctions if warranted.

SECTION 6.       Effectivity

This Regulation shall take effect fifteen days after the completion of its publication in a newspaper of general circulation.
