[ PCA ADMINISTRATIVE ORDER NO. 01, July 26, 1990 ]

RULES AND REGULATIONS TO IMPLEMENT NEW COPRA CLASSIFICATION STANDARDS



The following rules and regulations are hereby promulgated for the purpose of implementing a new standard of classifying copra.

SECTION 1.       Coverage . — Effective November 2, 1990, all copra dealers, copra exporters and oil millers, including their buying stations shall comply with the Table of Premia and Discounts At Various Copra Moisture Contents (given below) and made an integral part of this Administrative Order.

SECTION 2.       Mold Infection. — Copra delivery should not have mold infection exceeding ten percent (10%). Any copra delivery infected with molds or more than ten percent (10%) shall be rejected.

Any copra dealer who rejects copra delivery due to the aforementioned reason shall, within twenty-four (24) working hours advise the nearest oil miller, or copra exporter of such rejection to warn the latter against buying the rejected poor quality copra. Any oil miller or copra exporter rejecting copra delivery due to the aforementioned reason shall likewise advise the nearest copra buyer (oil-miller, copra exporter, or copra dealer).

SECTION 3.       Copra Goma . — Any copra delivery containing copra goma shall be discounted as follows:

SECTION 4.       Dust and Foreign Matters . — Any copra delivery containing dust, dirt, or other matters shall be discounted at the rate of one percent (1%) for every one percent (1%) of dust/foreign matter.

The determination of the weight of dust/foreign matter shall be subject to the mutual agreement of buyer and seller.

SECTION 5.       Information Campaign . — From August 1, 1990 to October 31, 1990.  It shall be the responsibility of all oil millers, copra exporters, and their buying stations to finish their copra dealers with the copies of this Administrative Order.  All oil millers and copra exporters shall post in conspicuous places copies (in English and in the dialect translation) of this Administrative Order effective November 2, 1990.  Within the same period, all copra dealers shall inform their sellers (farmers or other small dealers) of the detailed provisions of this Administrative Order.  All copra dealers shall also do the same posting of this Administrative Order effective November 2, 1990.

For the information and guidance of all copra producers PCA regional officers and extension workers shall also conduct the same information campaign.

SECTION 6.       Penalty . — For any violation of the provisions of these Rules, the Authority may impose any or all of the following sanctions:

a.       Non-processing of application for export and/or non-issuance of export clearance and/or permit to load;

b.       Cancellation/suspension of the Certificate of Registration.

In addition to the administrative sanctions mentioned above, the person or entity responsible for such violation shall, upon conviction, be punished by a fine of not more than twenty thousand pesos (P20 ,000.00) and by imprisonment of not more than five (5) years.  If the offender be a corporation, partnership, or juridical person, the penalty shall be imposed on the officer authorizing, permitting, or tolerating the violation.  An alien found guilty of any offense shall, after having served his sentence be immediately deported and, in case of a naturalized citizen, his certificate of naturalization shall be cancelled.

SECTION 7.       Repealing Clause . — All orders, rules and regulations inconsistent with the foregoing provisions are hereby repealed or modified accordingly.

SECTION 8.       Effectivity . — Except for Section 5, these rules and regulations shall take effect on November 2, 1990.
