RESOLUTION NO. R-729, APPROVING THE DELETION OF DEPARTMENT OF AGRARIAN REFORM (DAR) EXEMPTION CLEARANCE FROM THE LIST OF DOCUMENTARY REQUIREMENTS PRESCRIBED IN THE RULES AND REGULATIONS TO GOVERN THE PROCESSING OF APPLICATIONS FOR LOCATIONAL CLEARANCE FOR POULTRY AND PIGGERY PROJECTS, MARKETS AND THE IMPLEMENTING RULES AND REGULATIONS FOR MEMORIAL PARKS AND CEMETERIES



Attached herewith is a copy of the above stated resolution, no. R-729, which was approved by the Board on 21 August 2002.

The above was published in The Philippine Daily Inquirer on 25 September 2002, and, in accordance with the provisions of law, shall take effect fifteen (15) days from its date of publication.

APPROVING THE DELETION OF DEPARTMENT OF AGRARIAN REFORM (DAR) EXEMPTION CLEARANCE FROM THE LIST OF DOCUMENTARY REQUIREMENTS PRESCRIBED IN THE RULES AND REGULATIONS TO GOVERN THE PROCESSING OF APPLICATIONS FOR LOCATIONAL CLEARANCE FOR POULTRY AND PIGGERY PROJECTS, MARKETS AND THE IMPLEMENTING RULES AND REGULATIONS FOR MEMORIAL PARKS AND CEMETERIES  

WHEREAS, the Rules and Regulations to Govern the Applications for Locational Clearance for Markets, Memorial Parks and Cemeteries and Poultry and Piggery Projects were approved per HLURB Resolution Nos. 674, 681 and 682, S. of 2000, respectively;

WHEREAS, the same Rules and Regulations require submission of DAR Exemption Clearance as part of the documentary requirements for the processing of locational clearance for poultry and piggery projects, markets and for processing of preliminary and final approval of memorial park/cemetery plan;

WHEREAS, the Board approved last 19 June 2002 via Resolution No. 725 the deletion of DAR Exemption Clearance as a requirement for the issuance of Development Permit for subdivision and condominium projects and that in lieu thereof, a zoning certification issued by the HLURB Regional Officer be submitted indicating that the project site is within the area zoned for urban use (i.e. other than agricultural) prior to June 1988;

WHEREAS, for consistency in Board's policy relative to DAR Exemption Clearance, the Management Committee in its meeting last 24 July 2002, recommended the deletion of the said requirement in other land development projects such as poultry and piggery, markets and memorial parks and cemeteries;

WHEREFORE, BE IT APPROVED AS THE SAME IS HEREBY APPROVED, that DAR Exemption Clearance be deleted as part of the documentary requirements for the processing of locational clearance for poultry and piggery projects and markets and the preliminary and final approval of memorial park/cemetery plan, and that in lieu thereof, a zoning certification issued by the HLURB Regional Officer be submitted indicating that the project site is within the area zoned for urban use (i.e. other than agricultural) prior to June 1988.
